WHEREAS, the opportunity to be heard requirement does not apply to certain actions of <br />a board or commission, as provided in Section 286.0114(3), Florida Statutes; and <br />WHEREAS, the circuit courts have jurisdiction to issue an injunction for the purpose of <br />enforcing Section 286.0114, Florida Statutes, upon t he filing of an application for such <br />injunction by a citizen of this state, pursuant to Section 286.0114(6), and to award attorney fees <br />under Section 286.0114(7); and <br />WHEREAS, if a board or commission adopts rules or policies in compliance with this <br />section and follows such rules or policies when providing an opportunity for members of the <br />public to be heard, the board or commission is deemed to be acting in compliance with this <br />section. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br />SECTION I. That the City Commission of the City of Casselberry hereby adopts the <br />City Commission Meeting and Agenda Policies attached hereto as Exhibit "A" and made a part <br />hereof. <br />SECTION II. All Other City Boards. All City Boards will allow public comment at <br />their meetings except for emergency, ministerial, or quasi-judicial items. <br />SECTION III. Conflicts. That Resolution 13 -2497 is hereby repealed in its entirety, and <br />all Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution <br />are hereby repealed. <br />SECTION IV. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effects of any other Section or part of this Resolution. <br />SECTION V.
