Code Enforcement Lien Waiver Request — 370 Piney Ridge Road, Case #CE -09- <br />01279 <br />Mayor Glancy passed the gavel to Vice Mayor Solomon and left the Commission Chambers at 6:07p. in. <br />Staff Presentation: Interim Community Development Director Sandra Smith explained that this item was a <br />request from a property owner to reduce an existing lien balance of $750. She advised that the original <br />violation occurred in 2009 and was for trash and debris on the property. She added that a daily fine was <br />imposed and accrued to $2,500. Ms. Smith explained that a waiver request had previously been made in May <br />of 2012, at which time the Code Enforcement Board had recommended that the City Commission deny the <br />waiver request. She added that a payment arrangement had been made with the property owner and eight of <br />ten payments had been made, reducing the lien to a balance of $750. <br />Ms. Smith explained that the property owner had recently contacted the City and requested a waiver of the <br />remaining balance on the lien due to the death of her husband causing a financial hardship on her. Ms. Smith <br />added that the matter had gone back before the Code Enforcement Board on July 11, 2013 and the Board was <br />recommending that the City Commission grant the waiver of the remaining $750 balance. <br />In response to questions from the Commission, Ms. Smith confirmed that the property owner was not in <br />attendance at the meeting and that the property was not her primary residence but a rental property. <br />City Attorney Reischmann clarified for the Commission that a decision on this type of matter was to be based <br />on the record from the Code Enforcement Board as opposed to taking public comment. She added for the <br />record that the property owner had advised in writing that she would be unable to attend the meeting due to an <br />eye problem. She also confirmed that the Code Enforcement Board was recommending that the Commission <br />approve the waiver of the lien balance. <br />Mayor Glancy returned to the Commission Chambers at 6:09 p.m. <br />MOTION: Commissioner Aramendia moved to deny the request for waiver of the $750 <br />balance of the Code Enforcement Lien in Case #CE -09 -01279 for property <br />located at 370 Piney Ridge Road. Motion was seconded by Vice Mayor <br />Solomon. <br />Discussion: A brief discussion ensued regarding the fact the property was a rental property and whether a true <br />hardship existed. Commissioner Aramendia stated he did not wish to set a precedent for waiving liens and <br />suggested the possibility of extending the deadline for payment or reducing the payments might be more <br />appropriate. <br />Motion carried unanimously by voice vote 5 -0. <br />
