CASSELBERRY CITY COMMISSION <br />Minutes of August 26, 2013 — Regular Meeting <br />Page 11 of 17 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />RELATING TO THE PROVISION OF STREET LIGHTING SERVICES, FACILITIES AND <br />PROGRAMS WITHIN THE INCORPORATED AREA OF THE CITY; ESTABLISHING THE <br />STREET LIGHTING ASSESSMENT ROLL; CONFIRMING THE PRELIMINARY RATE <br />RESOLUTION; PROVIDING FOR THE REIMPOSITION OF THE STREET LIGHTING <br />ASSESSMENTS; PROVIDING FOR COLLECTION OF THE ASSESSMENTS PURSUANT TO THE <br />UNIFORM ASSESSMENT COLLECTION ACT; PROVIDING FOR THE EFFECT OF THIS <br />RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING SEVERABILITY AND AN <br />EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Resolution 13 -2523 was published in the <br />Orlando Sentinel on August 1, 2013. <br />Staff Presentation: Special Projects Coordinator Marty Pawlikowski stated that if approved, this would be <br />the fifth time the Commission would have approved collection of the street lighting assessment. He advised <br />that this year's assessment would include an additional 800 properties which had not previously been assessed, <br />and that each of the property owners had been notified of the assessment by mail. He stated that staff was <br />recommending approval of the assessment, and if approved, would be providing the new assessment roll to the <br />Seminole County Tax Assessor for inclusion in the annual tax bills. In response to questions fiom Mr. Newlon <br />and Mayor Glancy, Mr. Pawlikowski clarified that there would be no change in the amount of the assessment, <br />which was a result of the additional properties being assessed. <br />Budget Impact: Approval of Resolution 13 -2523 will generate approximately $300,000 in revenue in the <br />Streetlight Fund which will be utilized to offset related expenditures. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution <br />13 -2523. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Resolution 13 -2523. The following <br />individuals came forward to address Resolution 13 -2523: <br />1. Ms. Sharon Smith, property owner of 23 and 25 Teresa Court, voiced opposition to <br />Resolution 13 -2523, stating that Teresa Court was a privately owned road and street lighting <br />was unnecessary. She added that she felt she and her fellow property owners should not have <br />to pay an assessment for what was not needed. <br />2. Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to Resolution 13 -2353, stating he <br />also felt lighting was not necessary on Teresa Court. He expressed additional concerns about <br />the cost of lighting throughout the City and felt more economical lighting should be utilized in <br />the areas where lighting was actually needed. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Resolution 13 -2523. <br />MOTION: Commissioner Hufford moved to approve Resolution 13 -2523, as presented. <br />Motion was seconded by Vice Mayor Solomon. Motion carried 4 -1 by voice <br />vote, Commissioner Aramendia dissenting. <br />
