CITY OF CASSELBERRY CODE ENFORCEMENT BOARD MEETING JUNE 13, 2013 MOTION: Mr. Smith moved to find Respondents in case # 13 -00350 in violation of the City Code as charged and that Respondents correct the violation before 1:00 p.m. on 06/27/2013. In the event Respondents do not comply by this date, a fine in the amount of $50.00 per day will be imposed for each day the violation continues past the aforestated date. The Respondents are further ordered to contact the Code Compliance Officer to verify compliance with this Order. Mr. Bakalla seconded the motion. The motion passed unanimously. Abandoned /neglected real property, ArticleVI Chapter 58 Section 6(a) • CE -13 -00366 6 Hitching Post Ln Officer Hull gave testimony for the above case. There was no one present to speak for this case. MOTION: Mr. Bakalla moved to find Respondents in this case in violation of the City Code as charged and that Respondents correct the violation before 1:00 p.m. on 06/27/2013. Parkin utility trailer, ULDR Section 3 -10.9 • CE -13 -00482 4 Heritage Cove Ct Repeat Violation Officer Hull gave testimony for the above case and advised the Board that this is a repeat violation. There was no one present to speak for this case. MOTION: Mr. Smith moved to find Respondents in this case was /were in repeat violation of City Code as charged based on the Board's prior order entered against the same Respondents for the same violation. The Respondents brought the property into compliance on 05/22/2013. A fine in the amount of $50.00 is hereby imposed for 1 (day) of repeat violation. Mr. Herron seconded the motion. The motion passed unanimously. NEW CASES - STANDING ORDER REQUEST Overgrown, trash, debris, ULDR Section 3 -10.3 • CE -13 -00398 237 Bridle Path Officer Hull advised the Board that this case had complied prior to this meeting date, and the City requested a standing order for any future violations of the same code. MOTION: Mr. Lutz moved to find Respondents in this case were in violation of City Code as charged and failed to correct the violation by the time specified for correction by the Code Compliance Officer; that the violation is now corrected and no fine imposed. Any violation of the same code by Respondents within FIVE (5) years from the date of this Order shall be treated as a repeat violation, for which a fine of up to $500.00 per day may be imposed.
