LA► 1 -1 <br />WHEREAS, Casselberry City Code Sections 2- 153(e), 2 -234, and 58- 162(E)(4) <br />provides super priority of certain City liens; and <br />WHEREAS, the Florida Supreme Court ruled in City of Palm Bay v. Wells Fargo <br />Bank, N.A., 2013 WL 2096257 (Fla. May 16, 2013) that code enforcement liens are not <br />superior to other liens; and <br />WHEREAS, the City Commission wants to ensure the City Code is in concert with <br />the Florida Supreme Court's determination; and <br />WHEREAS, words with double underlined type shall constitute additions to the <br />original text and strike through shall constitute deletions to the original text, and asterisks (* * <br />*) indicate that text shall remain unchanged from the language existing prior to adoption of <br />this Ordinance. <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of <br />Casselberry, Florida: <br />SECTION I. Section 2- 153(e), Administrative fines and liens, costs of repair; and <br />filing of liens„ of Chapter 2, Administration, is hereby amended as follows: <br />Sec. 2153. — Administrative fines and liens, costs of repair; and filing of <br />liens. <br />* ** <br />(e) A certified copy of an order imposing a fine may be recorded in <br />the public records of the county and thereafter shall constitute a lien against <br />the land on which the violation exists and upon any other real or personal <br />property owned by the violator. All liens filed by the Gede enfnrnoment board <br />shall be lienS Go equal with the lien Of all state, GGunty, diGtFiGt and MURiGOE4 <br />
