modal capital improvements, as calculated in the impact fee study. The multi -modal transportation system <br />includes capacity- adding construction of through lanes; turn lanes; bridges; drainage facilities in conjunction <br />with new multi -modal capital improvements; traffic control devices; relocating utilities to accommodate new <br />multi -modal construction; conservation area mitigation; compensating storage; transit amenities, including <br />bus stations and necessary reconfigurations; corridor studies; environmental assessments; capital facility <br />fee studies and comprehensive plan element studies; or bicycle and pedestrian facilities, which mitigate the <br />impact of new development as calculated in the impact fee study. <br />Neighborhood Park: A City park with a service area and associated amenities consistent with the <br />impact fee study and which is used as the basis for calculating the impact fees for the city park system. <br />Offsite Improvements: Capital improvements located outside of the boundaries of a capital <br />improvement impact project, which are required by the City in order to mitigate the demands of capital <br />improvement impact projects other than those of the proposed capital improvement impact project. Offsite <br />improvements do not include access improvements. <br />Owner: The person holding legal title to the real property upon which the capital improvement <br />impact project is to occur. <br />"Sfgla ": Square feet of gross leasable area. <br />Square Footage or "sf": The gross area measured in feet from the exterior faces of exterior walls or <br />other exterior boundaries of the building. <br />Section 53.4. Rules of Construction. For the purposes of administration and enforcement of <br />this chapter, unless otherwise stated in this chapter, the following rules of construction shall apply: <br />A. In case of any difference of meaning or implication between the text of this chapter and any <br />caption, illustration, summary table or illustrative table, the text shall control. <br />B. Unless the context clearly indicates the contrary, where a regulation involves two or more <br />items, conditions, provisions or events connected by the conjunction "and ", "or ", or "either ... or ", the <br />conjunction shall be interpreted as follows: <br />(1) The term "and" indicates that all the connected terms, conditions, provisions or <br />events shall apply. <br />(2) The term "or" indicates that all the connected items, conditions, provisions or events <br />may apply singly or in any combination. <br />(3) The term "either ... or" indicates that the connected items, conditions, provisions or <br />events shall apply singly but not in combination. <br />C. The word "includes" shall not limit a term to the specific example, but is intended to extend <br />its meaning to all other instances or circumstances of like kind or character. <br />Section 53.5. Fees Imposed. <br />A. All capital improvement impact projects occurring within the City shall pay the impact fees <br />established in this chapter. The impact fees are imposed on all capital improvement impact projects located <br />in the City, at the rates established under the applicable impact fee land use category below.
