City Trail Facilities: Shared use paths, usually on exclusive right of way, with minimal cross flow by <br />motor vehicles. Users of city trail facilities are non - motorized and may include, but are not limited to <br />bicyclists, in -line skaters, roller skaters, skateboarders, pedestrians, walkers, runners, people with baby <br />strollers, and people walking dogs. <br />Collector Road: A road on the multi -modal transportation system and classified by the state <br />department of transportation utilizing the definition established in F. S. §334.03(4) or its statutory successor <br />in function, or a road classified as a collector road under the procedures of and meeting the criteria <br />specified by the City. A collector road shall include those portions of an intersection with an arterial or local <br />road that are a necessary and integral element of the design of the traffic flow on the collector road. <br />Community Park: A City park with a service area and associated amenities consistent with the <br />impact fee study and which is used as the basis for calculating the impact fees for the city park system. <br />Encumbered: Monies committed by contract or purchase order in a manner that obligates the City <br />to expend the encumbered amount upon delivery of goods or completion of services or conveyance of right - <br />of -way by a vendor, supplier, contractor or owner. <br />Fire and Rescue Facilities: Capital improvements provided by the City to accommodate capital <br />improvement impact project for the purpose of acquiring or expanding fire rescue services capital <br />equipment and /or facilities under the jurisdiction of the City. <br />Impact Fee Rate: An impact fee imposed for a particular capital improvement impact project under <br />the applicable impact fee land use category established in the schedule incorporated in Section 53 -5. <br />Impact Fee Statement: The document issued to an applicant prior to the issuance of a building <br />permit, containing the calculation of the impact fees imposed on capital improvement impact projects under <br />Section 53 -5 or 53 -7. <br />Impact Fee Study: The Impact Fee Study sets forth a reasonable methodology and analysis for the <br />determination of the impact of new development on the need for and costs of additional capital <br />improvements related to multi -modal transportation, city parks, law enforcement, and fire rescue services in <br />the City. The Study sets forth the calculations and basis for the impact fees utilized and associated with the <br />provision of city capital improvements needed to serve new development. The City Commission approved <br />the study through the Adoption of Resolution 13 -2482 on April 8, 2013 and all subsequent schedules and <br />analysis prepared by Tindale- Oliver & Associates, Inc. <br />Law Enforcement Facilities: Capital improvements provided by the City to accommodate capital <br />improvement impact projects for the purpose of acquiring or expanding police services capital equipment or <br />facilities under the jurisdiction of the City. <br />Level of Service Standard: The minimum acceptable conditions of the multi -modal transportation <br />system, the city park system, law enforcement facilities, or fire and rescue facilities, as set forth by the <br />comprehensive plan. <br />Mixed Use Capital Improvement Impact Projects: In which more than one impact fee land use <br />category is contemplated, with each category constituting a separate and identifiable enterprise not <br />subordinate to or dependent on other enterprises within the capital improvement impact project. <br />Multi -Modal Transportation System: The system of transportation, bike, pedestrian, or transit <br />improvements, shown on Map C -1 of the" Impact Fee Study," titled "City of Casselberry Proposed Collector <br />Multi -Modal Network ", which mitigate capital improvement impact projects' demand for road and multi- <br />Ordinance 13 -1393 <br />Page 5 of 18 <br />
