WHEREAS, expansion of capital improvement systems to accommodate new growth shall promote <br />and protect the public health, safety and general welfare of the residents of Casselberry; and <br />WHEREAS, in order for future growth to pay more equitably the cost of expanding necessary <br />capital improvement systems to meet the demands imposed by such growth, the City Commission finds <br />that it is necessary to update impact fees for the multi -modal transportation system, the city park system, <br />law enforcement facilities, and fire and rescue facilities; and <br />WHEREAS, the City Comprehensive Plan Objective TCE 1 states that the City "shall implement a <br />comprehensive transportation strategy to promote mass transit, pedestrian, and bicycle use with the City <br />and metropolitan area. This shall include a pedestrian and bicycle circulation system that addresses access <br />to commercial areas and a sidewalk program." To this end, the City has included on its Five Year Capital <br />Improvement Plan, bike and pedestrian improvements to serve new development and to be funded, in part, <br />by impact fees paid by new capital improvement impact projects; and <br />WHEREAS, the City Comprehensive Plan Objective TCE 2 includes policies for monitoring level of <br />service standards and implementation strategies for multi -modal transportation alternatives and <br />development impacts on the City's multi -modal system; and <br />WHEREAS, the City Comprehensive Plan Policy TCE 5.8 calls for the continued use of impact <br />fees to "provide transit opportunities throughout the City "; and <br />WHEREAS, the City has entered into a Memorandum of Understanding with the Central Florida <br />Regional Transportation Authority (LYNX), the City of Altamonte Springs, the City of Maitland, and the City <br />of Longwood to plan for and fund improvements to a regional transit system (the "FlexBus partnership "); <br />and <br />WHEREAS, the proposed FlexBus stations have been identified in the City along with potential <br />funding commitments by the City; and <br />WHEREAS, the City wishes to adopt a multi -modal impact fee to promote a mix of transportation <br />alternatives, in accordance with the City's Comprehensive Plan goals, objectives, and policies; and <br />WHEREAS, the intent of the City in imposing impact fees is to recover only the pro rata share of <br />the costs incurred to meet the demands of growth; and <br />WHEREAS, the report entitled "Impact Fee Study ", dated March 25, 2013, sets forth a reasonable <br />methodology and analysis for the determination of the impact of new development on the need for and <br />costs of additional capital improvements related to multi -modal transportation, city parks, law enforcement, <br />and fire rescue services in the City; and <br />WHEREAS, the City Commission adopted Resolution 13 -2482 on April 8, 2013, accepting the <br />Impact Fee Study dated March 25, 2013 and all subsequent schedules and analysis (the "Impact Fee <br />Study ") prepared by Tindale- Oliver & Associates, Inc; and <br />WHEREAS, the Impact Fee Study sets forth the calculations and basis for the impact fees utilized <br />Ordinance 13 -1393 <br />Page 2 of 18 <br />
