Ordinance 13 -1392 — Repealing Chapter 86 Utilities, Section 86 -68(fl Recovery of
Capacity
The City Cleric read Ordinance 13 -1392 by title as follows:
"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, REPEALING SECTION 86-
68(F), RECOVERY OF CAPACITY, CHAPTER 86, UTILITIES; PROVIDING FOR
CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE."
Staff Presentation: City Manager Randy Newlon explained that the City's Code contained language that
restricted a new business asking for utility service at a location that had been vacant for two years or more from
being eligible for a benefit credit to relieve some of the burden of connecting to City utilities. He added that it
did not seem reasonable to deny the credit to a new business when the capacity was already in place from a
previous business, and staff was requesting that the language denying the credit be stricken. He further added
that this would allow a new business to have the credit for a past business without a time restriction.
