CASSELBERRY CITY COMMISSION <br />Minutes of May 13, 2013 — Regular Meeting <br />Page 12 of 1S <br />Budget Impact: This action will temporarily limit the future growth of the City's general revenue based on <br />the exemptions approved by the City Commission. <br />Recommendation: The City Manager and the Interim Community Development Director recommended <br />approval of Ordinance 13 -1389. <br />Audience Input: The following individual came forward to address Ordinance 13 -1389. <br />Mr. James Fraleigh, 23 Teresa Court, voiced opposition to the ordinance, stating he felt there <br />was no benefit to the businesses already established in the City which had no room for <br />expansion and he felt it was wrong to create ordinances which did not benefit everyone <br />equally. He stated that the ordinance would be unfair to the City's residents, as they would <br />not benefit from tax revenues the City would not receive as a result of the program. <br />No one else came forward. <br />Mr. Newton noted there was a reference in the ordinance title to an application fee, but that there was no such <br />reference in the body of the ordinance. He advised that the ordinance would be amended to delete the <br />reference to the application fee prior to the second reading. <br />MOTION: Vice Mayor Solomon moved to approve Ordinance 13 -1389 on first reading, as <br />presented. Motion was seconded by Commissioner Aramendia. Motion carried <br />unanimously by voice vote 5 -0. <br />B. Ordinance 13 -1390 — Amendment to the Future Land Use Element Map for <br />Properties Located in the Vicinity of U.S. Highway 17 -92 and Triplet Lake Drive and <br />a Text Amendment (LPA 13 -03) <br />The City Clerk read Ordinance 13 -1390 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND <br />USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF MAJOR <br />THOROUGHFARE MIXED USE FOR THE PARCELS DESCRIBED IN SECTION 1 OF THIS <br />ORDINANCE; AMENDING TEXT IN FLU POLICY 1.22, MAJOR THOROUGHFARE MIXED <br />USE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Ms. Smith reminded the Commission that she had included information regarding this <br />item in her earlier presentation. She advised that there were ten (10) properties for which a Future Land Use <br />amendment was being proposed to Major Thoroughfare Mixed Use. She stated that the City owned seven (7) <br />of the ten (10) properties and that the other property owners had been advised of the proposed land use change <br />and had no objections. She added that in addition to the amendment to the fixture land use, staff was also <br />recommending a text amendment to the Future Land Use Policy regarding mixed uses, to allow mixed use <br />rather than require it. She stated that this was being proposed in order to avoid inhibiting any redevelopment <br />due to financing issues. <br />
