RESOLUTION 11 -2243 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF THE AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND R.G. LANDSCAPES, INC.; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, the City of Casselberry advertised for Tree Installation and Irrigation Services for designated sites throughout the City; and WHEREAS, R.G. Landscapes, Inc. was the lowest responsive and responsible bidder at $63,583.00 (a check total of combined unit pricing); and WHEREAS, the Purchasing Agent and Public Works staff have reviewed and evaluated the bid of R.G. Landscapes, Inc. and recommend approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION L The City of Casselberry hereby accepts the Agreement with R.G. Landscapes, Inc. attached as "Exhibit A" and authorizes the Mayor to execute said document on behalf of the City. SECTION II. The City Commission hereby accepts the term and conditions as presented in said Agreement. SECTION III. Conflicts. All Resolutions or parts of Resolution in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION V. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this day of °g` , AD 2011. ATTEST: A, 14 1 Donna G.
