WHEREAS, increasing the maximum allowed height of a fence or wall in the residential <br />districts requires conformity throughout the text within the Unified Land Development Regulations; <br />and <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed public <br />hearing on the proposed changes set forth herein and hereby finds this Ordinance to be in the best <br />interests of the public health, safety, and welfare of the citizens of the City of Casselberry and to be <br />consistent with the City of Casselberry's Comprehensive Plan; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text <br />and strike through shall constitute deletions to the original text. <br />SECTION 1. The Code of Ordinances for the City of Casselberry Part III, Unified Land <br />Development Regulations, Chapter Il, District and General Regulations, Article VII, "General <br />Regulations ", Section 2 -7.9, Accessory Structures, is hereby amended as follows: <br />Section 2.7.9. Accessory structures. <br />F. Tent -Like Structures as Accessory Structures. Erection of tent -like structures (to include tent or <br />canopy structures) to serve as accessory structures shall be subject to the following criteria: <br />1. The tent -like structure must be built in the back yard (i,e. behind the principal structure). In <br />the case of corner or through lots, tent -like structures are allowed in the portion of the lot <br />that is commonly used as the back yard by the occupant. <br />2. The tent -like structure shall be screened from any street by up to an eight (8) foot high a <br />six feet fence, wall or hedge to provide 100 percent opacity. It shall not be a violation of <br />this section if up to two feet of the top of the tent -like structure is visible from the street, <br />provided that the six feet eight (8) foot high fence, wall or hedge is in place. <br />3. If the tent -like structure is used to protect a parked vehicle, a paved driveway or permanent <br />designated area shall be constructed to connect the parking area to the driveway (per <br />Section 3- 10,9AA.a). <br />Ordinance 10 -1342 <br />Page 2 of 4 <br />
