10-1336 Amendment to ULDR to allow specific residential use exceptions

NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, Florida: SECTION 1. That Table 2 -5.3, Land use by district, of Article V, Zoning District Regulations, of Chapter ll, District and General Regulations, Part III, Unified Land Development Regulations, of the Code of Ordinances of the City of Casselberry, Florida shall be amended as follows: Section 2 -5.3, Table 2 -5.3 Land Use By District Footnotes: (4) Within an area designated for "commercial" development on the Comprehensive Plan's Future Land Use Map (FLUM), residential uses permitted within the OR district shall be restricted to single - family and two - family dwellings which are incidental to an approved commercial use. This footnote shall not apply to the fifteen (15) "Office Residential' properties which were amended to a "Commercial" Future Land Use designation as pad of Ordinance 10 -1335 on August 9. 2010. SECTION 2: CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION 3: CODIFICATION. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. SECTION 4. SEVERASILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION 5: EFFECTIVE DATE. This Ordinance shall become effective ten (10) days after the second reading and adoption. Adoption of this Ordinance is dependent upon the adoption of Ordinance 10- 1335. Should Ordinance 10 -1335 not achieve compliance through the Department of Community Affairs review process, this Ordinance shall become invalid. FIRST READING this 12th day of July, A.D. 2010.
