NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, <br />Florida: <br />SECTION 1. That Table 2 -5.3, Land use by district, of Article V, Zoning District Regulations, of <br />Chapter ll, District and General Regulations, Part III, Unified Land Development Regulations, of the Code <br />of Ordinances of the City of Casselberry, Florida shall be amended as follows: <br />Section 2 -5.3, Table 2 -5.3 Land Use By District <br />Footnotes: <br />(4) Within an area designated for "commercial" development on the Comprehensive <br />Plan's Future Land Use Map (FLUM), residential uses permitted within the OR district shall <br />be restricted to single - family and two - family dwellings which are incidental to an approved <br />commercial use. This footnote shall not apply to the fifteen (15) "Office Residential' <br />properties which were amended to a "Commercial" Future Land Use designation as pad of <br />Ordinance 10 -1335 on August 9. 2010. <br />SECTION 2: CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br />SECTION 3: CODIFICATION. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be <br />made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this <br />Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may <br />be changed to "Section," "Article," or other appropriate word. <br />SECTION 4. SEVERASILITY. If any Section or portion of a Section of this Ordinance proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Ordinance. <br />SECTION 5: EFFECTIVE DATE. This Ordinance shall become effective ten (10) days after the <br />second reading and adoption. Adoption of this Ordinance is dependent upon the adoption of Ordinance 10- <br />1335. Should Ordinance 10 -1335 not achieve compliance through the Department of Community Affairs <br />review process, this Ordinance shall become invalid. <br />FIRST READING this 12th day of July, A.D. 2010. <br />Ordinance 10 -1336 <br />Page 2 <br />
