10-1336 Amendment to ULDR to allow specific residential use exceptions

WHEREAS, the City Commission eliminated the "Office Residential" future land use (flu) category text from the Comprehensive plan by adoption of Ordinance 09 -1261 on July 13, 2009; and WHEREAS, the "Commercial" future land use designation will be applied to those properties on the future land use map (flum) that previously had an "Office Residential" future land use; and WHEREAS, the "Commercial" future land use designation restricts the ability of residential property owners to rebuild a residential structure or continue a residential use that is not incidental to a commercial use as provided within footnote #4 to Section 2 -5.3, Table 2 -53, Land use by district; and WHEREAS, application of the requirements within footnote #4 to Section 2 -5.3, Table 2 -5.3, Land use by district, would be a hardship on the property owners of the the existing, developed properties that currently have an Office Residential flu designation; and WHEREAS, the intent of the City Commission is to assist property owners and not to create a hardship; and WHEREAS, the City Commission of the City of Casselberry held a duly noticed public hearing on the proposed changes set forth herein and considered advice of staff, citizens, and all interested parties submitting written and oral comments and supporting data and analysis, and after complete deliberation, hereby finds the requested changes consistent with the City of Casselberry's Comprehensive Plan; and WHEREAS, words with double underlined type shall constitute additions to the original text and strike * shall constitute deletions to the original text.
