WHEREAS, the City Commission eliminated the "Office Residential" future land use (flu) category <br />text from the Comprehensive plan by adoption of Ordinance 09 -1261 on July 13, 2009; and <br />WHEREAS, the "Commercial" future land use designation will be applied to those properties on the <br />future land use map (flum) that previously had an "Office Residential" future land use; and <br />WHEREAS, the "Commercial" future land use designation restricts the ability of residential property <br />owners to rebuild a residential structure or continue a residential use that is not incidental to a commercial <br />use as provided within footnote #4 to Section 2 -5.3, Table 2 -53, Land use by district; and <br />WHEREAS, application of the requirements within footnote #4 to Section 2 -5.3, Table 2 -5.3, Land <br />use by district, would be a hardship on the property owners of the the existing, developed properties that <br />currently have an Office Residential flu designation; and <br />WHEREAS, the intent of the City Commission is to assist property owners and not to create a <br />hardship; and <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed public hearing on <br />the proposed changes set forth herein and considered advice of staff, citizens, and all interested parties <br />submitting written and oral comments and supporting data and analysis, and after complete deliberation, <br />hereby finds the requested changes consistent with the City of Casselberry's Comprehensive Plan; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text and <br />strike * shall constitute deletions to the original text. <br />
