NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of <br />Casselberry, Florida: <br />SECTION 1. That Chapter 78, Article VI, Tax Abatement Program, of the City of <br />Casselberry Code of Ordinances is hereby added as follows (double underlined indicates additions <br />to the City Code): <br />ARTICLE VI. TAX ABATEMENT PROGRAM. <br />Section 78 -90. Authority and purpose. <br />This article is adopted pursuant to the specific authority of section 196.1995, Florida Statues and <br />referendum approved by the citizens of Casselberry on November 6, 2012. <br />Section 78-91. Legislative findings. <br />Article VII Section 3 of the Constitution of the State of Florida and Section 196.1995 Florida <br />Statutes, enables municipalities to grant economic development ad valorem tax exemptions to <br />certain new businesses and expansions of existing businesses expected to create new jobs, after the <br />electors of the municipality, voting on the question in a referendum, authorize such exemptions. In <br />a referendum held on November 6, 2012, the electors of the City of Casselberry authorized the <br />City Commission to grant economic development ad valorem tax exemptions. <br />Section 78-92. Definitions. <br />The following words, phrases, and terms shall have the meanings set forth below. Except where <br />indicated otherwise, such words, phrases and terms shall have the same meanings attributed to <br />them in the Florida Statutes and Florida Administrative Code as amended from time to time: <br />Administrator. The City Manager of the City of Casselberry or such other person <br />designated by the City Manager, <br />Applicant. Any person, firm, partnership or corporation who files an Application with the <br />City Commission seeking an exemption. <br />Application. A written application for an Exemption on the form prescribed by the Florida <br />Department of Revenue, together with any supplemental form prescribed by the Administrator and <br />such other certificates, representations, document, data, or additional information requested by the <br />Administrator or the Seminole County Property Appraiser from time to time as may be reasonably <br />necessary or useful for the determinations contemplated by this Ordinance. <br />Authorizing Ordinance. Ordinance 13 -1389. <br />Average Wage in the City. The City of Casselberry average annual wage which may be <br />adjusted from time to time. <br />Brolvnfreld Area An area designated as a Brownfield area pursuant to Section 376.80 <br />Florida Statues. <br />Business.
