ORDINANCE 13 -1389 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 78, CREATING ARTICLE VI, TAX ABATEMENT PROGRAM, OF THE CITY OF CASSELBERRY CODE OF ORDINANCES; AUTHORIZING AN EXEMPTION FROM AD VALOREM TAXATION FOR CERTAIN NEW BUSINESSES AND EXPANSIONS OF EXISTING BUSINESSES; PROVIDING FOR AUTHORITY AND PURPOSE; PROVIDING LEGISLATIVE FINDINGS; PROVIDING FOR DEFINITIONS OF TERMS; PROVIDING FOR ESTABLISHMENT OF ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTION; PROVIDING FOR AN APPLICATION FOR AN EXEMPTION; PROVIDING FOR CITY COMMISSION CONSIDERATION OF SUCH APPLICATIONS; PROVIDING FOR CITY COMMISSION REVOCATION OF EXEMPTION; PROVIDING FOR A SUNSET DATE; PROVIDING FOR CONFLICTS, CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, The City Commission of the City of Casselberry believes that local government should support economic growth by providing an incentive for job creation that will lead to the improvement of the quality of life of the City of Casselberry and the positive expansion of our economy; and WHEREAS, the City Commission desires to expand the commercial and industry tax base by offering an ad valorem tax exemption to certain qualifying new businesses and expansions of existing businesses already located in the City of Casselberry; and WHEREAS, the granting of ad valorem tax exemptions to such businesses will provide the City of Casselberry with an additional economic development incentive and enhance the ability of the City of Casselberry to compete for new business development and retain local businesses with planned expansions which will increase employment opportunities; and WHEREAS, local governments are authorized to grant such tax exemptions pursuant to Article VII, Section 3, of the Florida Constitution and Section 196.1995, Florida Statutes upon the successful passage of an approving referendum; and WHEREAS, the electors of the City of Casselberry have authorized the offering of ad valorem tax exemptions to qualified new and expanding businesses in a referendum held on November 6, 2012, in accordance with Sec. 196.1995, Florida Statutes; and WHEREAS, words with double underlined type shall constitute additions to the original text of this Chapter or Code.
