Any person seeking election to the City Commission who is unable to pay <br />the one percent qualifying fee without imposing an undue burden on his or <br />her personal resources or on resources otherwise available to the person <br />shall, upon written certification of such inability given under oath to the <br />City Clerk, be exempt from paying the one percent qualifying fee and may <br />qualify to have his or her name placed on the ballot by means of the <br />following petitioning process: <br />(1) Upon receipt of the written oath from the candidate, the City <br />Clerk shall provide the candidate with petition forms in sufficient <br />numbers to facilitate the gathering of signatures required pursuant <br />to this Section. The petition forms shall indicate the seat for which <br />the candidate is running. <br />(2) When the candidate has filed the oath and received the petition <br />forms prescribed herein, the candidate may begin to seek <br />signatures on the petitions supporting his or her candidacy. Only <br />signatures of qualified electors of the City of Casselberry shall be <br />counted toward obtaining the number of signatures required in this <br />subsection. The candidate shall obtain 100 signatures of qualified <br />electors or the signatures of a number of qualified electors equal to <br />at least two percent of the total number of qualified electors, <br />whichever is the lower. <br />(3) Each petition shall be filed with the City Clerk on or before the <br />third Tuesday in " Aaril. The City Clerk shall determine whether <br />the required number of signatures has been obtained for the name <br />of the candidate to be placed on the ballot and shall notify the <br />candidate. <br />SECTION 2. CONFLICTS. All ordinances or parts of ordinances in conflict <br />herewith be and the same are hereby revoked. <br />SECTION 3. SEVERABILITY. If any section or portion of a section of this <br />Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair <br />the validity, force or effect of any other section or part of this Ordinance. <br />SECTION 4. CODIFICATION. It is the intention of the City Commission of the <br />City of Casselberry, Florida, and it is hereby ordained that the provisions of this <br />Ordinance shall become and be made a part of the Code of Ordinance of the City of <br />Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re- <br />lettered to accomplish such intention; that the word, "Ordinance" may be changed to <br />"Section," "Article," or other appropriate word. <br />Ordinance No. 11 -1368 <br />Page 2 <br />
