indicated on the return receipt. Proof of service shall be by written declaration indicating the <br />date, time, and manner in which service was made. <br />4. Hearing. <br />a. Scope of hearing. A hearing before the Code Enforcement Board shall offer the property owner <br />and other legally interested parties a reasonable opportunity to be heard on any matter or issue <br />which is relevant to the case. The property owner or other interested parties may appear at the <br />hearing in person or through an attorney or other designated representative. Failure of any <br />person to appear at a hearing scheduled in accordance with the City Code shall constitute a <br />waiver of the right to a hearing on the Notice of Violation. <br />b. Implementation. <br />1 If no hearing is requested as provided in subsection 3.a.(6), the Building Official may take <br />action to remove or demolish the building or structure as directed by the City Manager, <br />2 If a hearing is requested and the Code Enforcement Board determines; <br />A) That the condition exists as set forth in the Notice of Violation, and that the remedial <br />action required in the notice has not been voluntarily completed by the property owner, <br />or other legally interested party, the Code Enforcement Board shall issue a written order <br />authorizing the Building Official to remove or demolish the building or structure, or <br />cause the removal or demolition of the building or structure. <br />B) That the condition, as set forth in the Notice of Violation, does not exist or has been <br />corrected as required by the Notice of Violation, the Notice of Violation shall be <br />decision of the Code Enforcement Board may apply to the City Commission for relief within ten <br />certiorari review, based solely on the record of the hearing before the Code Enforcement Board. <br />1 _) References to the Board of Adjustment shall be to the City Commission; and <br />2 Appeals from the City Commission decision shall be to the Circuit Court. <br />5. The Building Official may, upon written request of the property owner, grant an extension of time as <br />the Building Official may determine to be reasonable to complete the required remedial action. If the <br />extensions of time, in total, exceed one hundred twenty (120) days, the extension must also be <br />approved by the Code Enforcement Board which may act without further public hearing. <br />6. Interference. No person shall obstruct or interfere with the implementation of any action required by <br />the final notice of the Building Official or the Code Enforcement Board. Any person found interferjng <br />or obstructing such actions shall be prosecuted to the extent provided for =W law. <br />7. Performance of work. The demolition of a building or structure, as required in the notice by the <br />Building Official or the final Order by the Code Enforcement Board, shall be performed in an <br />Ordinance 11 -1352 <br />Page 4 <br />
