the owner of record, and all interested aarties as identified by a search of the public records, in and <br />for the county. <br />a. Requirements. The Notice of Violation and the Notice of Pending Administrative Action shall <br />_....__.._..._- - <br />contain the following information, including, but not limited to; <br />1) The street address and legal description (if available) of the building, structure, or property. <br />2) A statement indicating construction on the building or structure has ceased and the <br />building permit has expired for more than one hundred and eighty days (180) in violation of <br />Section 1 -4.7, and a summary of the facts which led to that determination. <br />3) If the building or structure is occupied, a statement indicating the time period in which <br />occupants must vacate the building or structure, if applicable. <br />4) A statement of the remedial action to be taken, including but not limited to; obtaining a new <br />building permit to complete construction, a date certain for completion of construction with <br />a final approved inspection, or demolition of the building or structure, with or without further <br />notice. <br />5) A statement that, after such removal or demolition by or on behalf of the Building Official, <br />the City may approve and record a lien against the owner to recover costs pursuant to the <br />City Code. <br />6) Inform the person served with the notice, and any other person having a legal interest in <br />the property that, if the property owner or other interested party wishes to contest in whole <br />or in part the material allegations in the notice, if the property owner or interested party <br />desires to assert that the time period as set forth in the notice poses an undue hardship, if <br />the property owner or other interested party wishes to assert that the true intent and <br />meaning of the code has been misconstrued or misinterpreted, or if the property owner or <br />other interested party desires to make any other argument, the parties have a right to a <br />hearing before the Code Enforcement Board. Any request fora hearing before the Code <br />Enforcement Board must be made in writing within seven (7) days of receipt of Notice of <br />Violation; otherwise the right to a hearing is waived. <br />b. Recordation of notice. A Notice of Pending Administrative Action shall be recorded with the <br />Clerk of Court, served upon the property owner and other interested party as indicated below, <br />and containing the name of the property owner, the specific violation of Section 1 -4.7 of the <br />City Code and the property address and legal description. <br />C, Service of Notice of Violation and Notice of Pendina_Administrative Action. The Notice of <br />Violation with any and all attachments and the Notice of Pending Administrative Action shall be <br />served upon the property owner by posting a copy of each Notice of Violation and Notice of <br />Pending Administrative Action upon the property in a conspicuous place and where practical <br />by hand delivery or where not practical or impossible by certified mail, return receipt requested <br />to each interested party of record at the address as it appears in the public records. If the <br />addresses are not available on any interested party. the notices addressed to such person <br />shall be mailed to the address of the building or structure involved in the proceedings. If the <br />notices addressed to the owner of record is returned for any reason then service shall be <br />affected by posting the notices in accordance with F.S. Ch 162 The failure of any person <br />other than the owner of record, to receive notice shall not invalidate proceedings under this <br />section Service by certified mail shall be effective on the date the notices were received as <br />Ordinance 11 -1352 <br />Page 3 <br />
