Planning & Zoning Commission/ Local Planning Agency December 14, 2011 Page 2 Fifth Item of Business: SPR 11.19: Grace Mellow Tree Reduction Request. Property located at 5001 Highway 17 -92, Casselberry, Florida. Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated December 14, 2011, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part of the minutes). Mr. Sorensen said staff does not believe that the applicant has demonstrated that the reduction to 1 tree at 4" dbh is warranted and staff has determined that 4 trees (10" dbh) could be safely placed on the site. Mr. Sorensen requested the Planning and Zoning Commission make a determination on the applicant's request. In response to the Commission's question, Mr. Sorensen stated that the tree replacement would be reduced from 40.5" dbh to 10" dbh (4 trees at 2.5" dbh). A brief discussion ensued regarding the applicant paying into the tree bank fund. Mr. Sorensen said that staff would like to see the trees planted on the site. In response to the Commission's question, Mr. Sorensen stated that the City's Arborist has determined that the tree is in a dying stage and the tree will eventually rot. Mr. Parkhurst asked the applicant to come forward. Mr. Michael Schultz, representing the property owner, 2601 Madeline Avenue, Winter Park, Florida came forward. Mr. Schultz felt that 4 trees could be added to the site. He said that it is a financial hardship to Ms. Mellow, He said that Ms. Mellow wanted to remove the tree because it is unsightly. A brief discussion ensued regarding the applicant paying into the City's tree bank fund in lieu of planting trees on the site. Ms. Smith explained that the Planning and Zoning Commission could make a motion to allow the applicant to replace 10" on the site by either planting trees or payment into the City's tree bank fund. A general discussion ensued regarding the applicant planting trees on the site, contribution to the tree bank fund and the authority of the Planning and Zoning Commission to reduce the number of required trees on a site. Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. Mr. Keith Moore, 2003 Lake Howell Lane, Casselberry, Florida came forward.
