Planning & Zoning Commission/ <br />Local Planning Agency <br />September 12, 2011 <br />Page 2 <br />Fifth Item of Business: LPA 11.14: Brittany Gardens Continued. Amending the Brittany Garden Developer's <br />agreement as referenced in the City of Casselberry Code of Ordinances Part III, Unified Land Development <br />Regulations, Chapter II, District and General Regulations, Article V, Zoning District Regulations. <br />Ms. Sandra Smith, Development Services Manager, stated this agenda item was to modify the Brittany <br />Garden's Developer's Agreement to change the setback requirements. Ms. Smith stated this item is being withdrawn <br />from the agenda. <br />In response to the Board's question, Ms. Smith explained that changing the setback requirements would <br />require all the homeowners in the subdivision to sign an agreement before the changes could be binding. A brief <br />discussion ensued regarding the role of the Board of Adjustment. <br />Sixth Item of Business: LPA 1113: Property Maintenance /Public Nuisance. Amending portions of the City <br />Code including Chapter 70, "Solid Waste ", Chapter 58, "Offenses and Miscellaneous Provisions ", and ULDR <br />Article X, "Appearance, Design and Compatibility" to differentiate between public nuisances and property <br />maintenance criteria and the affiliated methods for compliance. <br />Ms. Sandra Smith, Development Services Manager, reviewed the information provided in her memorandum <br />dated October 12, 2011, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the <br />Community Development Department). Ms. Smith provided a PowerPoint presentation (a copy is attached and made <br />a part of the minutes). Ms. Smith explained that this item was advertised as a public hearing; however, at this time <br />the City Attorney has not completed her review of the Code. Ms. Smith stated that she would like to conduct this as a <br />workshop and request a continuance to the November 9, 2011 Planning and Zoning Commission meeting. It was <br />decided that Ms. Babb - Nutcher would review the language in the public nuisance portion of the ordinance and make <br />any necessary changes. Ms. Smith stated that Dr. Kelly Brock, Assistant Public Works Director would review the <br />public right -of -way portion of the ordinance and that information would be provided to the Planning and Zoning <br />Commission at the next meeting. <br />The Commission reviewed Section 3 -10.3 Minimum Maintenance Standards and Guidelines portion of the <br />ordinance. Ms. Smith provided suggested revisions to the draft ordinance during the discussion (a copy is attached <br />and made a part of the meetings). Ms. Smith said she would incorporate the changes made this evening along with <br />the revisions made by the City Attorney and the Assistant Public's Works Director and provide the revised document <br />to the Planning and Zoning Commission. <br />
