Mr. Sorensen reviewed a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). <br />Mr. Sorensen said upon review of the conditional use request, the Planning and Zoning Commission's <br />approval of CU 11 -11 to allow the on -site consumption of alcoholic beverages as allowed by the 2COP state license, <br />in conjunction with the operation of a dance studio located at 1271 State Road 436, Suite 127, would be based on <br />the findings of fact and conclusions of the staff report dated August 10, 2011, and the following conditions: <br />1. The conditional use shall be limited to the location of 1271 State Road 436, Suite 127. <br />2. All sales and consumption of alcoholic beverages shall be on -site and indoors. <br />3. Sales of alcoholic beverages must not exceed 20% of total revenue. <br />4. Alcohol shall only be sold to students and guests of students. <br />5. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />6. The hours of alcohol sales shall comply with the hours set forth in Section 10 -2 of the City of <br />Casselberry Code. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. There shall be no outside display or storage of goods, materials, services or vehicles. <br />9. The conditional use shall commence within 90 days of the approval. <br />10, Notarized property owner authorization shall be provided to staff. <br />11. The conditional use shall expire if the use is discontinued for more than 90 days. <br />12. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />Mr. Parkhurst asked the applicant to come forward. Mr. Gus Rogowski, owner, 1271 State Road 436, <br />Casselberry, Florida came forward. In response to the Commission's question regarding the percentage of other <br />Arthur Murray Dance Studios selling alcoholic beverages, Mr. Rogowski said there are other independent dance <br />studios that sell alcoholic beverages but he had no personal knowledge of any Arthur Murray Dance Studios selling <br />alcohol. Mr. Rogowski said that 8% of the entire revenue for the studio is paid to the franchise owner. <br />Ms. Smith said if the Commission was concerned about the use and the sale of alcohol, the Commission <br />could limit the alcohol sales to the hours of operation for the dance studio. A brief discussion ensued regarding <br />regulating on -site consumption of alcohol and adding references to the City of Casselberry to the Arthur Murray <br />website. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />
