In response to the Commission's question, the applicant said they agree with staffs conditions of approval. Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. A discussion ensued regarding the screening of the outdoor storage area. The applicant stated they are submitting for a building permit to construct an 8 foot fence in that area. Mr. Parkhurst asked for a motion to address CU 11 -09. Mr. Aramendia recommended approval of CU 11 -09 based on the staff report dated July 8, 2011 from Mr. Sorensen to the Planning and Zoning Commission as presented. Mr. Bakalla seconded the motion. The motion passed unanimously by voice vote. Seventh Item of Business: CU11. 10:1810 State Road 436 / Casselberry 436 Pet Clinic. Conditional use request to operate a veterinary clinic without outside kennels in a CG (Commercial General) zoning district. Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated July 8, 2011, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the minutes). Mr. Sorensen stated upon review of the conditional use request, the Planning and Zoning Commission's approval of CU 11 -10 to allow a veterinary clinic without outside kennels use within the CG zoning district at the property located at 1810 State Road 436, would be based on the findings of fact and conclusions of the staff report dated July 8, 2011, and the following conditions: 1. The conditional use shall be limited to the location of 1810 State Road 436 and shall not take up more than 3,000 square feet of tenant space. 2. There shall be no outdoor or indoor boarding of animals. 3. Animal feces outside shall be collected and disposed of accordingly on at least a daily basis. 4. There shall be no outside display or storage of goods, materials, services or vehicles. 5. The conditional use shall commence within 120 days of the approval, 6. The conditional use shall expire if the use is discontinued for more than 90 days. 7. All signage requires additional permit approval and must comply with all City requirements; 8. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void.
