Planning & Zoning Commission/ <br />Local Planning Agency <br />November 14, 2012 <br />Page 2 <br />Mr. John Ingram, Interstate Sign & Light Corp, 6958 Venture Circle, Orlando, Florida came forward. Mr. <br />Ingram said when they were originally hired to survey the property it was a larger unit and they were unaware that the <br />unit was being sub - divided. He said there were delays in issuing the sign permit. Mr. Ingram said the signs were <br />erected without the permit due to the scheduled grand opening. He said that the signs were too large due to the <br />space being subdivided. He said if the front door was located on the Howell Branch Road side of the building the <br />signage would meet the City Code. Mr. Ingram requested a variance to allow the additional signage. He said if the <br />owner does not receive the variance it will cause an unnecessary financial hardship on a small business owner to <br />replace the signage or relocate the front door. <br />A general discussion ensued regarding the signs being installed without a permit, Staffs denial of the permit <br />for the signage and the delays that occurred in the permitting process. <br />Ms. Sandra Smith, Interim Community Development Director, reviewed the information provided in her <br />memorandum dated November 14, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on <br />file in the Community Development Department). Ms. Smith provided a PowerPoint presentation (a copy is attached <br />and made a part of the minutes). <br />Ms. Smith stated the variance application does not meet all six criteria for granting the variance; therefore, <br />City Staff cannot support the request. Ms. Smith said if the Planning and Zoning Commission chooses to grant the <br />variance requested for BA 12 -07, for the property located at 1455 State Road 436, Suite 281, to allow 4.75 square <br />feet of signage copy area for each linear foot of building frontage (based on the true store frontage) the motion <br />should be based upon findings of fact and conclusions developed by the Planning and Zoning Commission and the <br />following Staff requested conditions: <br />1. The variance of 4.75 square feet per 1 foot of building frontage will be based on 40 feet of frontage facing <br />State Road 436. The total copy area for the tenant at 1455 State Road 436, Suite 281, shall not exceed <br />189 square feet. <br />2. If the long side of the tenant space which currently measures 96 feet and 11 inches is reduced in size, the <br />variance shall become null and void. <br />3. A building permit for the signage shall be obtained from the City's Building Safety Division within 90 days of <br />the approval of the variance. <br />4. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />
