Planning & Zoning Commission/ <br />Local Planning Agency <br />July 11, 2012 <br />Page 3 <br />Sixth Item of Business: CU 12.07: 1405 Seminola Boulevard /7- Eleven. Conditional use request to allow fuel <br />dispensing in a CS zoning district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated July 11, 2012, <br />to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). <br />Mr. Sorensen said staff recommends approval with the following conditions: <br />1. The Conditional Use shall be limited to the location of 1405 Seminola Boulevard. <br />2. The Conditional Use shall be limited to six (6) fueling stations with twelve (12) fuel positions. <br />3. The applicant shall obtain major site plan approval through the City's Planning and Zoning Commission. <br />The eastern perimeter shall provide adequate buffering from the adjacent use. <br />4. The applicant shall develop under the City of Casselberry's CS (Commercial Service) zoning district <br />standards. <br />5. All site lighting shall meet the requirements of Section 3 -10.2 of the City's Unified Land Development <br />Regulations. <br />6. Noise shall not exceed the levels indicated in Section 3 -17.4 of the City's Unified Land Development <br />Regulations, <br />7. The applicant shall provide pedestrian connectivity through the site from Lake Drive to Seminola <br />Boulevard. This shall be accomplished through the major site plan process. <br />8. The business shall remain in complete compliance with all City, County and State requirements. <br />9. There shall be no outside display or storage of goods, materials, services or vehicles. <br />10. The service station shall remain in compliance with any state or federal regulations which are pertinent <br />to a fuel dispensing business. <br />11. The conditional use shall commence within 1 year of the approval. <br />12. The conditional use shall expire if the use is discontinued for more than 90 days. <br />13. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />After a brief discussion, Mr. Meadows asked the applicant to come forward. Mr. Stuart Anderson, Interplan, <br />604 Courtland Street, Orlando, Florida came forward. Mr. Anderson said there are no issues with the conditions of <br />approval and he was available to answer any questions. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />There were no final comments from staff or the applicant. Mr. Meadows asked for a motion to address CU <br />12 -07. Mr. Wadley made a motion that the Planning and Zoning Commission approve CU 12 -07 to allow a fuel- <br />dispensing service station use at 1405 Seminola Boulevard based on the findings of fact and conclusions of the staff <br />
