Planning & Zoning Commission/ <br />Local Planning Agency <br />June 13, 2012 <br />Page 7 <br />Mr. Meadows asked the applicant to come forward. Mr. Faheem Zia, 3529 Munsey, Casselberry, Florida <br />came forward. Mr. Zia suggested that the Planning and Zoning Commission consider conditional use approval for <br />schools locating in shopping center. He explained when he was looking for a site for his pool hall, he was prohibited <br />from locating in a shopping center that had a church or school due to the distance separation requirements for <br />alcohol sales. He said, as a business owner, the Board should take that into consideration when approving <br />conditional uses. Mr. Zia agreed with Mr. Wadley regarding the law being written as a double standard — the school <br />can locate near a bar but a bar is required to meet the distance separation. <br />Mr. Zia explained that he meets the distance separation requirements from the school that is located across <br />the street from his business. He said that the physics teacher from that school brought his students to his business <br />to teach them the laws of physics. Mr. Zia felt that if it was done right the two types of businesses could co- exist, <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for final comments from staff and the applicant. There were no final comments made. <br />Mr. Meadows asked for a motion to address CU 12 -05. Mr. Wadley made a motion to approve CU 12 -05 to <br />allow the on -site consumption of alcoholic beverages as allowed by the 4COP state license, in conjunction with the <br />operation of a bar /lounge located at 2050 State Road 436, Unit 100, based on the findings of fact and conclusions of <br />the staff report dated June 13, 2012 and the nine conditions of approval contained in the staff report. Mr. Weinroth <br />seconded the motion. The motion passed unanimously by voice vote. <br />Eighth Item of Business: CU 12 -06: 80 Golden Days Drive /The Crepe Company. Conditional use request to <br />allow a wholesale bakery /commissary in the CG zoning district. <br />Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated <br />June 13, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part <br />of the minutes). <br />Mr. Sorensen said upon review of the conditional use request, the Planning and Zoning Commission's <br />approval of CU 12 -06 to allow a wholesale bakery use within the CG zoning district at the property located at 80 <br />
