Planning & Zoning Commission/ <br />Local Planning Agency <br />May 9, 2012 <br />Page 2 <br />Fifth Item of Business: SPR 1211: Action Gator Tire Store. Tree reduction request for 980 State Road 436, <br />Casselberry, Florida. <br />Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated <br />May 9, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part <br />of the minutes). <br />Mr. Sorensen said the site contains several oak trees, three pine trees, a cluster of oak trees on the eastern <br />end of the property and a large grassy field. He said in January the applicant received a notice from the Code <br />Compliance Department for a dead 20" dbh oak, He said the applicant submitted a tree removal permit and <br />requested a reduction to the tree replacement requirements. <br />Mr. Sorensen stated that the Planning and Zoning Commission has the authority to reduce the number of <br />required replacement trees per Section 3 -14.8 of the Unified Land Development Regulations; however, the applicant <br />has not demonstrated that a reduction is warranted as required by the Code. <br />Mr. Sorensen stated that staff does not support a reduction since the site can accommodate numerous <br />trees. Mr. Sorensen provided the following suggested conditions of approval: <br />1. The applicant must submit to staff a replacement plan for 20" dbh. <br />2. The above condition shall be fully and faithfully executed within three months of the making of this <br />determination or the landscape restoration plan shall become null and void and code enforcement <br />action will commence. <br />After a brief discussion, Mr. Meadows asked if the applicant was available to answer questions from the <br />Commission. The applicant was not present at the meeting. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for final comments from the Commission and staff. There were no additional <br />comments from the staff. Mr. Hale felt that the site could accommodate the replacement trees. <br />
