Planning & Zoning Commission/ <br />Local Planning Agency <br />April 11, 2012 <br />Page 2 <br />Development Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part of <br />the minutes). <br />Mr. Sorensen said staff recommends approval of SPR 12 -01. Mr. Sorensen stated if the Planning and <br />Zoning Commission chooses to recommend approval to the City Commission of SPR 12 -01, site plan for a Waffle <br />House restaurant, 202 State Road 436, it would be based on the information provided in the staff report dated April <br />11, 2012, the site plan dated March 26, 2012 and building elevations attached to the staff report and the following <br />conditions: <br />1. The Planning and Zoning Commission approves the site modification to ULDR Section 3 -15 to <br />allow 4 parking spaces (17 %) to be 9'X 18' rather than 10'X 20'. <br />2. The applicant is required to obtain preliminary plat approval from the City Commission prior to <br />issuance of a building permit. <br />3. All Public Works issues must be addressed prior to issuance of a site construction permit. <br />4. All conditions must be fully executed or the site plan becomes null and void. <br />5. The site plan is valid for one year. Failure to obtain a building permit within one year will result in <br />the expiration of the site plan approval. <br />After a brief discussion regarding staffs recommendation, Mr. Meadows asked the applicant to come <br />forward. Mr. Ryan Peterson, 5986 Financial Drive, Norcross, Georgia came forward. Mr. Peterson said he was <br />available to answer any questions. A brief discussion ensued regarding the color for the building. Mr. Peterson said <br />due to the City's architectural requirements the yellow fascia band was eliminated. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for any final and additional comments from the applicant or staff. There were no <br />additional comments made. <br />Mr. Meadows asked for a motion to address SPR 12 -01, Mr. Wadley made a motion to approve SPR 12 -01 <br />site plan for a Waffle House restaurant, including the five conditions of approval contained in the staff <br />recommendations including the site plan modification to allow the four parking spaces at 9' x 18' rather than 10' x 20' <br />and based on the staff report presented, the site plan dated March 26, 2012 and the building elevations. Mr. Bryan <br />seconded the motion, The motion passed unanimously by voice vote. <br />
