Mr. Sorensen said this is a <br />variance request for a shed encroachment of 12 feet into a required 20 foot rear setback. He said that the applicant <br />is required to meet the six criteria for granting a variance. Mr. Sorensen said the applicant does not meet any of the <br />criteria required to grant a variance. Mr. Sorensen said the applicant has created the hardship condition by <br />constructing the shed without a permit. <br />A general discussion ensued regarding the term of the original variance approved by the City Commission <br />and the criteria required to grant a variance. Mr. Meadows asked for a motion to address BA 12 -01. Mr. Guzman <br />recommended denial of BA 12 -01 based on the finding that not all 6 criteria have been met as set forth in Unified <br />Land Development Regulations Section 1 -2.7. A brief discussion <br />ensued regarding Sunshine Laws. In response to a question from the Commission regarding emails sent to the <br />Commissioners, Ms. Babb - Nutcher explained that the Commission can reply to the email but as a general rule should <br />not reply to all recipients of the email. She said the Commissioners would also need to disclose information <br />regarding emails as ex parte communication on that subject. <br />Mr. Meadows welcomed the new Board members. A general discussion ensued regarding the landscaping <br />located in the construction areas for the Red Bug Lake Road flyover project. Mr. Sorensen said that FDOT works <br />directly with the property owner regarding any construction that affects their property. Mr. Sorensen said there was <br />
