Planning & Zoning Commission/ <br />Local Planning Agency <br />February 8, 2012 <br />Page 3 <br />A brief discussion ensued regarding the anticipated time frame for the completion of the Red Bug Lake <br />Road Flyover project and adding a completion date to Phase II of the tree restoration plan based on the anticipated <br />road work completion date. <br />Mr. Meadows asked the applicant to come forward. Mr. Julius Lopez, 11624 Rouse Road Circle, Orlando, <br />Florida came forward. Mr. Lopez said the road improvement project has encroached into his landscaping and has <br />damaged his sprinkler system. Mr. Lopez said that Florida Department of Transportation (FDOT) said that they <br />would repair the sprinkler system and replace the landscaping. Ms. Smith explained that the road improvements are <br />part of the Seminole County/FDOT Red Bug Lake Road Flyover project. She said the owner of Citgo site was not <br />aware that the road improvement project would impact his property until the landscaping was removed. <br />Mr. Lopez said that the trees he removed from the site would have been removed by FDOT for the road <br />improvement project. He said he is being penalized for trees that were going to be removed for the road <br />improvement project. <br />In response to the Commission's question, Mr. Lopez said he agrees with staffs conditions of approval. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />A brief discussion ensued regarding the phasing of the project. Mr. Meadows asked for a motion to address <br />SPR 12 -03. Mr. Wadley made a motion to approve SPR 12 -03 to accept the plan as being reasonable and the staffs <br />analysis as reasonable and he moved to accept the applicant's revised restoration plan for SPR 12 -03 for Citgo <br />Express located at 970 State Road 436 with Phase 1 to be completed by April 8, 2012 and Phase II to be completed <br />when the Red Bug Lake Road flyover project is completed by FDOT's scheduled date.
