Planning & Zoning Commission/ <br />Local Planning Agency <br />March 13, 2013 <br />Page 6 <br />Mr. Sorensen said the variance application meets one of the six criteria for granting the variance. He said <br />staff recommends denial. He said if the Planning and Zoning Commission chooses to grant the variance requested <br />for BA 13 -01, for the property located at 2215 Winslow Circle, to allow an 8' encroachment into the 20' rear yard <br />building setback for a covered porch, the motion should be based upon the Planning and Zoning Commission's <br />findings of fact and conclusions, the property site plan attached to the staff report as Exhibit A, and the following <br />conditions: <br />1. The variance shall only pertain to the building addition of the impervious roof porch cover as shown in <br />the staff report. <br />2. A building permit for the structure shall be obtained from the City within 90 days of the approval by the <br />Planning and Zoning Commission. <br />3. The structure shall meet all other site development criteria at the time of permitting. <br />4. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br />In response to the Commission's question, Mr. Sorensen stated that a screen room has a 5' setback from <br />the rear property line. Mr. Sorensen explained that under the City Code the 20' setback applies to this structure <br />because it has a roof and it is attached to the main structure. <br />A brief discussion ensued regarding the side yard setback and previous variances granted in the area. <br />Mr. Meadows asked the applicant to come forward. Ms. Lynn Hastings, 2215 Winslow Circle, Casselberry, <br />Florida and Mr. Tom Hastings, 101 Bush Boulevard, Sanford, Florida came forward, In response to the <br />Commission's question, Mr. Hastings stated that the walls would be screened. The Commission was concerned that <br />the screen room would be turned into a room with masonry walls. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />After a brief discussion regarding granting the variance, Mr. Meadows asked for a motion to address BA 13- <br />01, Mr. Bryan moved that the Planning and Zoning Commission grant the variance for BA 13 -01 for the property <br />located at 2215 Winslow Circle to allow a 12' rear yard setback in lieu of the 20' rear setback required for structures <br />in the R -9 zoning district. He said the motion is based on the Planning and Zoning Commission's finding of fact and <br />conclusions, the property site plan attached to the staff report as Exhibit A and the five conditions of approval outlined <br />
