Motion carried unanimously by <br />voice vote 5 — 0. <br />A. Second Reading of Ordinance 12-1385 — Internet Cafd Moratorium <br />The City Clerk read Ordinance 12-1385 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, IMPOSING A TEMPORARY <br />MORATORIUM FOR 180 DAYS ON THE ISSUANCE OF ANY BUSINES TAX LICENSE, PERMIT, <br />CONDITIONAL USE APPROVAL, SITE PLAN APPROVAL AND ANY OTHER OFFICIAL <br />ACTION OF THE CITY OF CASSELBERRY HAVING THE EFFECT OF PERMITTING OR <br />ALLOWING THE CONSTRUCTION AND/OR OPERATION OF CERTAIN BUSINESSES WITHIN <br />THE CITY OF CASSELBERRY, RELATED TO GAME ROOMS, ARCADES, INTERNET CAFES, <br />SWEEPSTAKES REDEMPTION CENTERS AND SIMILAR INDOOR ENTERTAINMENT AND <br />AMUSEMENT ACTIVITIES AS MORE SPECIFICALLY DESCRIBED IN THIS ORDINANCE, <br />EXCLUDING APPROVALS AND PERMITS FOR THE CONTINUANCE OF AN EXISTING <br />BUSINESS; THE TEMPORARY MORATORIUM SHALL APPLY TO ALL REAL PROPERTY <br />LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY; <br />PROVIDING A PROCEDURE FOR EXTRAORDINARY HARDSHIP; PROVIDING FOR <br />SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE." <br />Notice of Hearing: The Notice of Public Hearing relative to Ordinance 12-1385 was published in the Orlando <br />Sentinel on January 17, 2013. <br />Staff Presentation: Interim Community Development Director Sandra Smith gave a brief overview of the <br />item, explaining that Ordinance 12-1385 would prohibit the issuance of any official document that may enable <br />the location of a new arcade, internet cafe, sweepstakes redemption center or similar indoor entertainment and <br />amusement activity within the City until July 27, 2013. She added that the ordinance also included a provision <br />for an exception based on hardship, and there was a process set out for that. <br />City Attorney Katie Reischmann gave a brief update on the status of the Seminole County litigation, advising <br />that Allied Veterans was out of the case, but there were other plaintiffs that were now the lead plaintiffs. She <br />stated that the mediation was to be held by May of 2013 and the trial by November of 2013. Ms. Reischmann <br />also advised that Seminole County had amended their ordinance to include the use of passwords or codes in <br />addition to swipe cards, and that ordinance was being challenged. She added that the Legislature was <br />supposed to be conducting a two-year gambling study, so it was unlikely that any legislation on this issue <br />would be passed in this year's session. <br />Budget Impact: There is no impact to the City Budget. <br />
