Commission on March 1, 1993 with a March 1, 1993 effective date; and
<br />WHEREAS, redundancies, scriveners errors, omissions, unclear text and conflicting text
<br />occur within various sections of the City Code of Ordinances that require correction through
<br />amendments; and
<br />WHEREAS, providing the corrections included within this ordinance will provide a better
<br />tool for the public and staff; and
<br />WHEREAS, Part II, Code of Ordinances, Chapter 2, Administration, Article V, Code
<br />Enforcement Citation, Section 2 -210, Schedule of code violations, includes dated language and
<br />incorrect code references; and
<br />WHEREAS, Part II, Code of Ordinances, Chapter 14, Amusements, Article II, Special
<br />Event, Open Air Sales, Open Air Food Sales, Seasonal Sales, And Temporary Structures, Division
<br />1, Generally, does not provide an opportunity for request for additional Open Air Sales or Open Air
<br />Food Sales event opportunities; and
<br />WHEREAS, Part II, Code of Ordinances, Chapter 14, Amusements, Article II, Special
<br />Event, Open Air Sales, Open Air Food Sales, Seasonal Sales, And Temporary Structures, Division
<br />2, Special Events, Section 14 -42, Performance criteria, provides criteria for additional Special
<br />Events days and this criteria should be included with the additional event opportunities provided for
<br />the open air events within Division 1, General; and
<br />WHEREAS, Part II, Code of Ordinances, Chapter 14, Amusements, Article II, Special
<br />Event, Open Air Sales, Open Air Food Sales, Seasonal Sales, And Temporary Structures, Division
<br />3, Open Air Sales, Open Air Food Sales and Seasonal Sales, Section 14 -52, Open air sales
<br />restricts the zoning districts for open air sales from Recreation Open Space which is where the City
<br />wants to promote community uses; and
<br />WHEREAS, Part III, Unified Land Development Regulations, Chapter II, District and
<br />General Regulations, Article V, Zoning District Regulations, Section 2 -5.3, Table 2 -5.3, Land Use
<br />by District, does not clearly define those businesses required to obtain a conditional use approval
<br />for businesses selling alcoholic beverages for on -site consumption; and
<br />WHEREAS, Part III, Unified Land Development Regulations, Chapter II, District and
<br />General Regulations, Article V, Zoning District Regulations, Section 2 -5.4, Size and Dimension
<br />Criteria, footnotes to Table 2 -5.4, provides an onerous requirement for minor construction in areas
<br />Ordinance 09 -1262
