SECTION 7. RELATED SERVICE ASSESSMENT. <br />(A) The Tax Parcels described in the Related Service Assessment Roll are hereby found to <br />be specially benefited by operation and maintenance of the Summerset North Subdivision Wall in the <br />amount of the Related Service Assessment set forth in the Related Service Assessment Roll. The <br />methodology for computing annual Related Service Assessments described in the Initial Assessment <br />Resolution is hereby approved. Annual Related Service Assessments computed in the manner described in <br />the Initial Assessment Resolution are hereby levied and imposed on all Tax Parcels described in the <br />Related Service Assessment Roll. Tax Parcels located in the Summerset North Assessment Area shall <br />have an annual Related Service Assessment rate of $30.50 per Benefit Unit for the life of the wall, <br />commencing with the tax bill mailed in November of 2005. This rate may vary with the adoption of <br />subsequent Annual Assessment Resolutions based on the annual Related Service costs incurred and the <br />balance of the 25% reserve account. <br />(B) Upon adoption of the Annual Assessment Resolution for each Fiscal Year, the Assessment <br />shall constitute a lien against assessed property equal in rank and dignity with the liens of all state, county, <br />district or municipal taxes and other non -ad valorem assessments. Except as otherwise provided by law, <br />such lien shall be superior in dignity to all other liens, titles and claims, until paid. The lien shall be deemed <br />perfected upon adoption by the City Commission of the Annual Assessment Resolution and shall attach to <br />the property included on the Assessment Rolls as of the prior January 1, the lien date for ad valorem taxes. <br />SECTION 8. COLLECTION OF ASSESSMENT. The Assessment shall be collected pursuant to <br />the Uniform Assessment Collection Act. Upon adoption of the Annual Assessment Resolution for each <br />Fiscal Year, the City Clerk shall cause the certification and delivery of the Assessment Roll to the Tax <br />Collector by September 15, in the manner prescribed by the Uniform Assessment Collection Act. <br />SECTION 9. EFFECT OF FINAL RESOLUTION. The adoption of the Final Resolution shall be <br />the final adjudication of the issues presented herein and in the Initial Assessment Resolution (including, but <br />not limited to, the method by which the Assessment will be computed, the Assessment Roll, the maximum <br />annual Related Service Assessment and the levy and lien of the Assessment) unless proper steps are <br />Resolution 05 -1608 <br />Page 3 of 7 <br />
