CASSELBERRY CITY COMMISSION <br />Minutes of August 13, 2012 — Regular Meeting <br />Page 8 of 11 <br />Ms. Smith explained that on November 2, 2012, Wells Fargo Bank foreclosed on the property. She added that <br />the City then stopped the accrual of the lien regarding the unpermitted structure against the former property <br />owner and opened a new case on December 23, 2012 naming the bank as the violator regarding the <br />unpermitted structure. She stated that the structure was removed 453 days after the Code Enforcement Board <br />Order and the fines stopped accruing, but the fine had accrued to $22,650. <br />Ms. Smith advised that the Code Enforcement Board met on July 12, 2012 and voted to recommend to the City <br />Commission to reduce the total of the first three liens from $82,950 to $20,737.50. She added that the Board <br />also voted to recommend denial of the request to reduce the lien against Wells Fargo Bank due to the amount <br />of time it took for the bank to mitigate the property after the Order was imposed, leaving the total amount of <br />that lien at $22,650. <br />Budget Impact: The lien amounts paid would be recognized in the City Budget as income received. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />consideration of the Code Enforcement Board's recommendation as follows: <br />Case number CE -07 -02426 — lien amount $57,600 reduced to $14,400 to be paid within 60 days <br />Case number CE -08 -01707 — lien amount $20,500 reduced to $5,125 to be paid within 60 days <br />Case number CE 10 -01041 — lien amount $4,850 reduced to $1,212.50 to be paid within 60 days. <br />Case number CE 10 -02552 — lien amount $22,650 reduction denied. <br />Audience Input: No one came forward to address this item. <br />MOTION: Vice Mayor Hufford moved to reduce the lien for case number CE -07 -02426 <br />from $57,600 to $14,400. Motion was seconded by Commissioner Miller. <br />Motion carried unanimously by voice vote 5 -0. <br />MOTION: Vice Mayor Hufford moved to reduce the lien for case number CE -08 -01707 <br />from $20,500 to $5,125. Motion was seconded by Commissioner Miller. Motion <br />carried unanimously by voice vote 5 -0. <br />MOTION: Vice Mayor Hufford moved to reduce the lien for case number CE -10 -01041 <br />from $4,850 to $1,212.50. Motion was seconded by Commissioner Miller. <br />Motion carried unanimously by voice vote 5 -0. <br />MOTION: Vice Mayor Hufford moved to deny a reduction of the lien for case number CE- <br />10- 02552, and to keep the lien amount at $22,650. Motion was seconded by <br />Commissioner Miller. Motion carried unanimously by voice vote 5 -0. <br />City Attorney Reischmann clarified that the City's Code calls for these reduction cases to be based solely on <br />the record, so for the future there would be no need for audience input. <br />
