CASSELBERRY CITY COMMISSION <br />Minutes of Tebruaiy 27, 2012 -Regular Meeting <br />Page 8 of 12 <br />Staff Presentation: Mr. Don Martin, Community Development Director, stated Ordinance 12-1371 provides <br />for imposition of a 180-day moratorium on issuance of City permits, approvals and any other official actions <br />related to Internet cafes and similar indoor entertainment and amusement activities within the City limits. The <br />current moratorium expires on March 9, 2012. If approved, Ordinance 12-1371 will provide for a new <br />moratorium to be in place until September 21, 2012. It is anticipated that the State and County's legislation <br />will be resolved by that time. The City Attorney reported on the status of the County related litigation. <br />Budget Impact: This item has no impact to the City Budget. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />approval of Ordinance 12-1371 on first reading. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 12-1371 on first <br />reading, as presented. Motion was seconded by Vice Mayor Hufford. Motion <br />carried unanimously by voice vote 5 - 0. <br />11. ESL~JT N~ <br />A. Resolution 12-2348 -Land Swap Settlement Agreement with Central Florida <br />Environmental, Inc. <br />The City Clerk read Resolution 12-2348 by title as follows: <br />"A RI!;SOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORISING THE <br />EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN CENTRAL FLORIDA <br />ENVIl20NMENTAL CORPORATION (CFE) AND THE CITY OF CASSELBERRY; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Ms. Catherine Reischmann, City Attorney, stated Resolution 12-2348 provides for a Land <br />Swap Settlement Agreement between the City of Casselberty and Central Florida Environmental, Inc. (CFE) in <br />the amount of $25,000. In return, CFE releases the City from all liability. On or about June 27, 2005, the City <br />entered into a Land Swap and Credit Agreement in connection with the realigmnent of North Winter Park <br />Drive. Back in 2006, CFE conveyed a parcel to the City which became part of the new road. CFE believes it <br />has claims or causes of action against the City arising from the City's failure to tunely perform its obligations <br />under the agreefent; however the City denies that it materially breached any of its contractual obligations to <br />CFE. The City has previously offered compensation to CFE in accordance with the terms of the agreement, a <br />
