APPROVAL OF BUDGET AMENDMENT NO. 12-023 & <br />ACCEPTANCE , <br />Presentation: City Attorney Catherine Reischmann reminded the Commission that at the last meeting the <br />Commission had directed her to meet with the City Manager and negotiate a mutually agreeable resignation <br />pursuant to her contract. She advised that the agreement and the related budget amendment, which were in <br />accordance with Ms. Lipscomb's contract, were contained in the Commissioners' packets for their review. Ms. <br />Reischmann further advised that for the purposes of Commission action, there would need to be a motion for <br />approval of the budget amendment and a separate motion to accept the letter of resignation, both of which were <br />in accordance with Ms. Lipscomb's employment agreement. <br />Budget Impact: The City Manager's severance and salary adjustment for the Interim City Manager will <br />cause a budget deficit of $115,726 in the Administration Division, making it necessary to draw funding <br />from the Non Departmental Contingency Reserve. <br />Explanation of Request: This item seeks City Commission approval to provide funding for the un- budgeted <br />costs associated with the separation of the City Manager and the placement of an Interim city Manager. At the <br />City Commission meeting held on Monday, January 23, 2012, the Commissioners determined that a change in <br />leadership for the City was desired and the City Manager was asked to negotiate a separation agreement. The <br />Commission also selected the Finance Director to be the Interim City Manager until further notice. The City <br />Manager's severance and salary adjustments for the Interim City Manager will cause a budget deficit of <br />$115,726 in the Administration Division making it necessary to draw funding from the Non Departmental <br />Contingency Reserve. The amendment will afford the ability to pay -out earned wages to the date of separation <br />accrued vacation and sick leave, severance of 26 weeks consistent with the departing City Manager's <br />employment agreement and all required employment tax and benefit costs.
