Board of Adjustment <br />December 1, 2011 <br />Page 3 <br />A general discussion ensued regarding the Administrative Official's Determination that was presented at the <br />August 25, 2011 Board of Adjustment meeting, the arches being utilized as a lighting feature, the loss of sales and the <br />alternative design option presented to City Staff. Ms. Scott explained that the alternative design option would be the very <br />last resort for Taco Bell as the arches are very important to their development. She said it is not desirable for the overall <br />design and the overall consistency of site. <br />Ms. Gauvin asked if there was anyone in the audience who wished to speak in opposition to the request. Ms. Scott said she had nothing <br />further to add to the discussion. <br />Mr. Guzman said there is nothing in the Unified Land Development Regulations that permits the Board of <br />Adjustment to take the loss of sales into consideration for appealing the Administrative Official's Determination. Mr. <br />Guzman said that the Board made a determination at the August 25, 2011 meeting that the arches met the definition of <br />signage and illumination does not play a part in determining signage, <br />Ms. Gauvin asked for a motion for BA 11-07. Mr. Guzman made a motion to uphold the Administrative Official's <br />Determination for BA 11-07. Ms, Smith <br />thanked Ms, Wallace for serving on the Board of Adjustment. <br />Ms, Smith explained that the Administrative Official has requested that appeals to the Administrative Official's <br />Determination duties be assigned to the Planning and Zoning Commission.
