Board of AdjusUnent
October 27, 2011
Page 5
Mr. Rosenthal said that earlier this year the shopping center declared bankruptcy because it can't support the
loan or the value of the property, Mr, Rosenthal said if Waffle House withdraws from the site, he is unsure what will
happen to the property in the future.
Mr, John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry felt that
the applicant was being burdened due to the narrowness of the frontage of the building, Mr. Casselberry felt that it was
better for the shopping center to have the narrow side of the out parcels towards the road because it provides a better
view of the shopping center. Mr. Casselberry suggested that the signage could be calculated based on a percentage of
the floor area of the building,
Mr, Guzman asked if there was anyone in the audience who wished to speak in opposition to the request. No
one came forward.
In response to the Board's question, Mr. Raasch stated that the applicant has the option to request a variance to
the signage or appeal the Board of Adjustment's decision.
Mr, Guzman asked the applicant to come forward, Mr. Peterson said the root of the problem is that staff
originally presented that the structure was allowed two square feet of copy area per linear foot of building frontage. Mr.
Peterson said the ordinance states that two square feet of copy area per linear foot of building frontage where the primary
entrance is located is allowed, He said that is a very important part of the language that is in the text that defines which
portion of the building frontage that needs to be used to determine copy area, Mr. Peterson said the root of the problem is
determining where the primary entrance is located defining how the signage should be calculated. He didn't feel there
was a need to go to the definition portion when it is defined in the context of the section,
After a brief discussion, Mr. Guzman asked for a motion for BA 11-08. Mr. McMullen made a motion to overturn
the Administrative Official's Determination, The motion failed due to the lack of a second,
Ms. Wallace made a motion to deny the appeal and uphold the Administrative Official's Determination for BA 11-
08. Mr. Weinroth seconded the motion, The motion passed with a majority vote with Mr. McMullen casting the dissenting
vote.
Seventh Item of Business: Other Business
There was no other business before the Board,
