Board of Adjustment <br />June 23,2011 <br />Page 4 <br />Mr. Larry Bittle, 2649 Queen Mary Place, Maitland, Florida came forward. Mr. Bittle said that the staff report <br />states that the applicant purchased the property understanding the existing conditions. He said he was youngerwhen he <br />purchased the house and now that he is older he has more medical problems and the heat it more difficult to handle. <br />Mr. Bittle stated that the edge of the roof would be approximately 10 feet from the wall. He said the wall is 8112 <br />feet high and it blocks the winds, Mr, Bittle requested the Board approve the variance, <br />Ms. Gauvin asked if there was anyone in the audience who wished to speak in favor of the request, Mr. Jon <br />Miller, 2693 Queen Mary Place, Maitland, Florida came forward to speak in favor of the variance. Mr. Miller said that the <br />Homeowners' Association President was here earlier to speak in favor of the request (but needed to leave due to an <br />emergency). Mr. Miller said approval of the variance would be in accordance with all the similar variances that have <br />previously been granted in the Brittany Garden's Subdivision. Mr. Miller said that staff will be working on some changes <br />for the Brittany Garden Planned Unit Development (PUD). He said Brittany Garden's subdivision has some of the <br />strictest code enforcement rules in the whole city. Mr. Miller felt that this variance is very similar to the variance granted <br />to Mr. Bongiorno. <br />Ms. Gauvin asked if there was anyone in the audience who wished to speak in opposition to the request. No <br />one came forward. <br />Mr. Weinroth stated that he is on the Board for the Brittany Gardens Homeowners' Association and he knows the <br />applicants. He said he is not involved with them personally or financially. He said he voted as a member of the <br />Homeowners' Association to approve their application. He said he reviewed the information regarding the variance <br />granted to his neighbor Mr. Bongiorno and he felt that the Bittle variance request was similar to that request. Mr, <br />Weinroth said he was in favor of granting the variance in spite of the City's objections to five out of the six criteria. Mr, <br />Weinroth said he has no financial interest and no direct contact with the applicants. He said he is acting impartially and <br />following the Board of Adjustment action last year to accept items 2 through 5. He said that the applicant had no ability to <br />change the existing wall and it is a hardship. <br />After a brief discussion, Ms. Gauvin asked for a motion for BA 11-04. Mr. Guzman made a motion to approve <br />BA 11-04 variance application for 2649 Queen Mary Place adopting the June 9, 2011 letter as to the part that deals with <br />
