of the qualifying fee is one percent (1 %) of the annual salary of the <br />office. Additionally, candidates shall comply with F.S. § 99.093, as <br />amended. <br />Any person seeking election to the City Commission who is unable to <br />pay the one percent (1 %) qualifying fee without imposing an undue <br />burden on his or her personal resources or on resources otherwise <br />available to the person shall, upon written certification of such inability <br />given under oath to the City Clerk, be exempt from paying the one <br />percent (1 %) qualifying fee and may qualify to have his or her name <br />placed on the ballot by means of the following petitioning process: <br />(1) Upon receipt of the written oath from the candidate, the City <br />Clerk shall provide the candidate with petition forms in <br />sufficient numbers to facilitate the gathering of signatures <br />required pursuant to this Section. The petition forms shall <br />indicate the seat for which the candidate is running. <br />(2) When the candidate has filed the oath and received the <br />petition forms prescribed herein, the candidate may begin to <br />seek signatures on the petitions supporting his or her <br />candidacy. Only signatures of qualified electors of the City of <br />Casselberry shall be counted toward obtaining the number of <br />signatures required in this subsection. The candidate shall <br />obtain 100 signatures of qualified electors or the signatures of <br />a number of qualified electors equal to at least two percent <br />(2%) of the total number of qualified electors, whichever is the <br />lower. <br />(3) Each petition shall be filed with the City Clerk on or before the <br />the third Tuesday in May. The City <br />Clerk shall determine whether the required number. of <br />signatures has been obtained for the name of the candidate to <br />be placed on the ballot and shall notify the candidate. <br />SECTIIV S V Il,l . If any section or portion of a section of this <br />Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair <br />the validity, force or effect of any other section or part of this Ordinance. <br />CTIN TFI E C®IICTIIV. It is the intention of the City Commission of <br />the City of Casselberry, Florida, and it is hereby ordained that the provisions of this <br />Ordinance shall become and be made a part of the Code of Ordinance of the City of <br />Casselberry, Florida; that the Sections of this Ordinance maybe renumbered or re-lettered <br />to accomplish such intention; that the word, "Ordinance" may b'e changed to "Section," <br />Ordinance No. 08-1236 <br />Page No. 2 <br />
