Planning & Zoning Commissionl <br />Local Planning Agency <br />May 11, 2011 <br />Page 11 <br />favorable recommendation to the City Commission to support the City Commission at the second reading of the <br />moratorium, <br />Ms. Smith stated that Seminole County passed legislation in January 2011 that prohibits simulated gambling <br />devices within the County which includes all the cities within the County. She said immediately Allied Veterans <br />sought an injunction; however, last week the Court lifted the injunction. Ms. Smith said that there may be additional <br />litigation so the City wanted to have a moratorium in place. <br />Ms. Smith requested the Planning and Zoning Commission provide a favorable recommendation to the City <br />Commission regarding the moratorium ordinance. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br />Casselberry questioned how many simulated gambling businesses were located in the City. He said that based on <br />the news reports for Allied Veterans he didn't think it was a game a chance. He thought it was similar to the old <br />"punch" cards. He wasn't sure if it met the definition of gambling. He suggested requiring the businesses to post the <br />odds of winning. <br />Mr. Parkhurst asked for a motion to address MISC 11-05. Mr. Aramendia made a motion to provide a <br />favorable recommendation for MISC 11-05 Internet cafe moratorium to the City Commission based on the staff report <br />dated May 11, 2011 from Ms. Smith as presented. Mr. Van Meter seconded the motion, The motion passed <br />unanimously by voice vote. <br />Fifteenth Item of business: ®ther Business. <br />A general discussion ensued regarding the process for resolving open building permits on properties, the <br />status of Phase 3 of the bike trail and the trees planted by the Public Works Department through the City's <br />Neighborhood Enhancement Project. <br />In response to the Commission's question, Ms. Smith stated the next meeting would be June 8, 2011. A <br />brief discussion ensued regarding the status of the State Road 436/Highway 17-92 Flyover Project. <br />Sixteenth Item of business: Adjournment. <br />
