Planning & Zoning Commission/ <br />Local Planning Agency <br />December 8, 2010 <br />Page 2 <br />Third Item of Business: MISC: 10.04: Pain Management Continued. Recommendation fora 180-day <br />moratorium on approvals for the operation of certain businesses within the City related to cash only <br />pharmacies, family medical practices and pain management clinics. <br />Ms. Sandra Smith, Chief Planner, stated that this item was discussed briefly at the November 10, 2010 <br />Planning and Zoning Commission meeting and the Commission provided a continuance to tonight's meeting. Ms. <br />Smith explained that staff took a resolution to the City Commission requesting legislation in process to allow staff <br />additional time to research this item. <br />Ms. Smith stated she attended a workshop presented to the Orange County Commission on November 9, <br />2010 that included a PowerPoint presentation. Ms. Smith presented a portion of that PowerPoint presentation to the <br />Commission (copies are attached and made a part of the minutes). <br />Ms, Smith reviewed the information provided in her memorandum dated December 8, 2010, to the City of <br />Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Ms. <br />Smith reviewed a draft ordinance that included revisions by the City Attorney (a copy is attached and made a part of <br />the minutes). Ms. Smith stated the City's ordinance for a moratorium is different from Orange County's in the <br />following areas: <br />o Casselberry's ordinance is for 180 days and Orange County's is for one year. <br />o Casselberry's ordinance includes a definition and prohibition fora "Cash only pharmacy". It also <br />states that a cash only pharmacy does not accept major credit cards. <br />o Casselberry's ordinance states that the cash only pharmacy and a pain management clinic do not <br />accept payment for services from an established insurance provider. <br />Ms. Smith requested the Planning and Zoning Commission provide a favorable recommendation to the City <br />Commission to provide a 180 day moratorium on the issuance of city approvals related to cash only pharmacies and <br />pain management clinics within the city limits. Ms. Smith stated that Ms. Drage has a wealth of information on this <br />topic and is available to answer any questions. A general discussion ensued regarding the length of the moratorium. <br />Mr, Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br />Casselberry said that good doctors count pills, He suggested requiring businesses to obtain a federal identification <br />
