ae pity tenter ®R®ban~ ®eve9®~rne~~ ~a~ner~ <br />Staff has prepared and forwarded a three part contract for consideration to Robbins <br />Development Partners including 1) a Contract For Sale and Purchase, 2) a Public/Private <br />Development Agreement and 3) a Conceptual Plan Agreement. Robbins Development <br />Partners has advanced a standard purchase contract back to the City for consideration. <br />One significant difference between the two documents is consideration of a timeline and <br />process for review of the development plan. While the original conceptual development <br />plan presented to the City Commission provided a vision for 225 apartment units and <br />32,000 square feet of commercial, the submitted standard purchase contract allows for <br />75,000 square feet of commercial in addition to the 225 apartment units. While staff may <br />not necessarily be opposed to developing the site with 75,000 square feet of commercial, <br />without a visual representation of how such development can work on the site or a <br />defined public/private process for reaching an agreeable development program, <br />advancing the submitted contract is problematic. <br />Robbins Development Partners is aware of the situation and is working to submit a <br />revised contract to address the concern. <br />3o Tar~e$ ~u~~a~cel~ <br />After considering the CRA's request to again make an offer to purchase the CRA parcels, <br />Mr. Rubin indicated thaf he would prefer that the CRA purchase his parcel. His stated <br />terms are a purchase price of $250,000 and to close by December 31, 2010. The <br />property's value per the Property Appraiser is $59,346. Even if the CRA Board found the <br />acquisition price agreeable, given the process that must be followed in order for the CRA <br />to purchase property, staff has determined it to be impossible to close by the end of the <br />year to satisfy Mr. Rubin's closing deadline. <br />The details of staff discussions with Mr. Rubin are attached. <br />4e brass Lake err®~erct <br />On November 30th, staff spoke with Javier Omana, Development Consultant for the <br />owner, Walter Judge of the Grassy Lake parcel. Earlier in the month, a meeting took <br />place between the owner, the development consultant, the owner's engineer, the City <br />engineer, and several Public Works staff. Mr. Judge's engineer is making revisions to the <br />plans per the recommendations of the City staff. Once these revised plans are finished, <br />another meeting will take place for final submittal. When the final plans are approved, <br />Mr. Judge will proceed with the site work. <br />The costs for extending the sewer will come from the City's water and sewer impact fees. <br />xxnxnxr raccalharrx~ nrn <br />
