Second Reading of Ordinance 11-1348 -Amendment to the City of Casselbel~X <br />Code of Ordinances, Chapter X, Alcoholic Beverages, Section 10-7, Sale Near <br />Churches Educational Institutions and Other Businesses <br />The City Clerk read Ordinance 11-1348 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; AMENDING THE CITY OF <br />CASSELBERRY CODE OF ORDINANCES, PART II, SEC. 10-7, SALE NEAR CHURCHES, <br />EDUCATIONAL INSTITUTIONS AND OTHER BUSINESSES, TO EXEMPT RESTAURANTS <br />THAT DERIVE AT LEAST 51 PERCENT OF GROSS REVENUE FROM THE SALE OF FOOD <br />AND NONALCHOLIC BEVERAGES FROM DISTANCE SEPARATION REQUII2EMENTS FOR A <br />2COP ALCOHOLIC BEVERAGE LICENSE; PROVIDING FOR CODIFICATION, <br />SEVERABILITY, CONFLICTS AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 11-1348 was published in the <br />Orlando Sentinel on April 14, 2011. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 11-1348 amends Section 10-7 ofthe <br />City Code by exempting restaurants that derive at least 51 percent of gross revenue from the sale of food and <br />nonalcoholic beverages from distance separation requirements for sale of alcohol near established churches and <br />places of worship, educational institutions, and bass and lounges. The City Commission approved Ordinance <br />11-1348 on first reading on March 28, 2011. Additionally, Section 10-7 outlines measurement methods for <br />required distance separations, but fails to address measurement from bars, lounges and bottle clubs. Staff <br />proposed the following language since the first reading which fiuther clarifies one specific measurnig point, the <br />"primacy" entrance, rather than multiple points, in Section 10-7 (2) Method of Measurement: <br />c. Bar, lounge, or bottle club: the prilnaly entrance to such establishment. <br />
