<br />CASSELBERRY CITY COMMISSION <br />Minutes of February 9, 2009. Regular Meeting <br />Page 8 of18 <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 09-1266 on second reading. <br /> <br />Public Hearing: No one came forward to address Ordinance 09-1266. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve Ordinance <br />09-1266 on second reading as presented. Motion was <br />seconded by Vice Mayor Hufford. Motion carried <br />unanimously by voice vote 5 - O. <br /> <br />C. Second Reading of Ordinance 09-1267 - Voluntary Annexation of934 Laura Street <br /> <br />The City Clerk read Ordinance 09-1267 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA, CERTAIN LANDS LOCATED IN SECTION 04, TOWNSHIP 21, RANGE 30; <br />REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW THE AREA TO BE ANNEXED SHALL <br />BE ASSESSED FORP A YMENTOF MUNICIP ALAD VALOREM TAXES; DIRECTING <br />THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE <br />CLERIC OF COURT AND THE SECRETARY OF STATE OF THE STATE OF <br />FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 09-1267 was published in <br />the Orlando Sentinel on January 25,2009 and February 1,2009. <br /> <br />Staff Presentation: Mr. Gerald Paradise, Community Development Director, stated Ordinance 09-1267 <br />provides for annexation of a parcel ofland and residential structure located at 934 Laura Street, east of U.S. <br />Highway 17-92. The lands to be annexed consist of approximately .5 acres which are adjacent and <br />contiguous to the City limits, will not create an enclave, is reasonably compact, is in an urban area as defined <br />in the criteria and meets the statutory requirements for annexation, as established in Chapter 171, Florida <br />Statutes. The subject property has a Seminole County future land use designation of Commercial and a RP <br />(Residential Professional) zoning designation. The City Commission passed Ordinance 09-1267 on first <br />reading on January 12,2009. <br />
