Second Reading of Ordinance 09-1265 - ULDR Amendment to Include Public <br />School Facilities Concurrency (ZB 08-05) <br /> <br />The City Clerk read Ordinance 09-1265 by title as follows: <br /> <br />"AN ORDINANCE CREATING CERTAIN PROVISIONS OF ARTICLE IX, <br />CONCURRENCY MANAGEMENT, OF THE CITY OF CASSELBERRY UNIFIED <br />LAND DEVELOPMENT REGULATIONS RELATING TO THE PUBLIC SCHOOL <br />F ACILITYELEMENT AND SCHOOL CONCURRENCY; CREATING SECTION 3-9.11, <br />PUBLIC SCHOOL FACILITY CONCURRENCY AND PROVIDING FOR <br />SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 09-1265 was published in <br />the Orlando Sentinel on January 29, 2009. <br /> <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 09-1265 incorporates State- <br />mandated School Facilities Concurrency planning requirements into the City's Unified Land Development <br />Regulations (ULDR). In January 2008, the City entered into the Interlocal Agreement for Public Schools <br />Facility Planning and School Concurrency with the other cities of Seminole County and the Seminole County <br />School Board. This agreement provides close coordination between all parties' comprehensive land use and <br />school facilities planning programs in order to achieve the public school concurrency goals. The proposed <br />amendments are required by the Interlocal Agreement and the adopted Public School Facilities Element <br />(PSFE) within the Comprehensive Plan. The amendments describe the responsibilities assumed by the City <br />in regard to Public School Facility Concurrency. The PSFE was reviewed and approved by the City <br />Commission on November 26,2007 as part of the Evaluation and Appraisal Report (EAR). The Planning <br />& Zoning Commission reviewed the proposed amendments on December 10, 2008 and unanimously <br />recommended approval to the City Commission. The City Commission approved Ordinance 09-1265 on first <br />reading on January 12,2009. <br /> <br />Budget Impact: This item has no budget impact. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 09-1265 on second reading. <br /> <br />Public Hearing: The following individual came forward to address Ordinance 09-1265: <br /> <br />I) Mr. John Casselberry, 700 South Lost Lake Lane, reiterated his concerns regarding <br />possible impacts to residential development in the City ifthe School Board lacked funding <br />for construction of any new schools needed. <br /> <br />No one else came forward. The public hearing relative to Ordinance 09-1266 was closed. <br />
