The <br />lands to be annexed consist of approximately .23 acres which are adjacent and contiguous to the City limits, <br />will not create an enclave, is reasonably compact, is in an urban area as defined in the criteria and meets the <br />statutory requirements for annexation, as established in Chapter 171, Florida Statutes. The subject property <br />has a Seminole County future land use designation of Commercial and a C-2 (Retail-Commercial) zoning <br />designation. Ordinance 08-1256 was continued on first reading on October 27, 2008 in order to respond to <br />statements made by the owner's representative regarding the validity of the annexation application for utility <br />service. The City Attorney has indicated that the annexation application for the utility service was and is <br />valid, and the City can proceed with the proposed annexation. The City Commission passed Ordinance 08- <br />1256 on first reading on January 12,2009. <br /> <br />Budget Impact: The subject property is valued at $204,052 and currently provides $950 in County property <br />taxes. The subject property will provide $1,003 in City property taxes and an estimated $1,344 total fiscal <br />impact as currently developed. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 08-1256 on second reading. <br /> <br />Public Hearing: No one came forward to address Ordinance 08-1256. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve Ordinance <br />08-1256 on second reading as presented. Motion was <br />seconded by Vice Mayor Hufford. Motion carried <br />unanimously by voice vote 5 - O. <br /> <br />10.
