First Reading of Ordinance 09-1309 - Amendment to the Automated Red Light <br />Enforcement Program <br /> <br />The City Clerk read Ordinance 09-1309 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; AMENDING ARTICLE VIII, <br />AUTOMATED RED LIGHT ENFORCEMENT, SECTION 82-238, OWNER RESPONSIBILITIES <br />AND SECTION 82-239, APPEAL TO HEARING OFFICER, OF THE CITY OF CASSELBERRY <br />CODE OF ORDINANCES TO PROVIDE FOR A HEARING IN THE EVENT A NOTICE OF <br />INFRACTION IS NOT TIMELY RECEIVED; PROVIDING FOR CODIFICATION, <br />SEVERABILITY, CONFLICTS AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Police Chief Jim Ruf stated Ordinance 09-1309 amends the Automated Red Light <br />Enforcement Program to provide an oPPOliunityforthe registered owner of a vehicle to request a hearing when <br />he or she may not have received a Notice of Infractio within the time period to appeal the violation. <br /> <br />Budget Impact: This item has on impact to the City's budget. <br /> <br />Recommendation: The City Manager and the City Police Chief recommended approval of Ordinance 09- <br />1309 on first reading. <br /> <br />MOTION: <br /> <br />Commissioner Solomon moved to approve Ordinance 09-1309 on first reading, <br />as presented. Motion was seconded by Vice Mayor Hufford. Motion carried <br />unanimously by voice vote 5 - O. <br /> <br />C. First Reading of Ordinance 09-1310 - Residential Property Foreclosures <br /> <br />The City Clerk read Ordinance 09-1310 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; CREATING ARTICLE VI, <br />"RESIDENTIAL PROPERTY FORECLOSURES" OF CHAPTER 58, "OFFENSES AND <br />MISCELLANEOUS PROVISIONS"; PROVIDING FOR DEFINITIONS; PROVIDING FOR THE <br />REGISTRATION OF RESIDENTIAL PROPERTIES IN DEFAULT OR FORECLOSURE; <br />PROVIDING FOR REQUIRED MAINTENANCE OF RESIDENTIAL PROPERTIES IN DEFAULT <br />OR FORECLOSURE; PROVIDING FOR PENALITIES; PROVIDING FOR CONFLICTS; <br />PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY OF PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE." <br /> <br />Staff Presentation: Police Lieutenant Scott Pleasants stated Ordinance 09-131 0 provides for the registration <br />and maintenance of residential properties in default or foreclosure, as well as penalties for not adhering to the <br />ordinance. The ordinance fmiher establishes a mechanism to protect residential neighborhoods from becoming <br />blighted through the lack of adequate maintenance and security of abandoned properties. <br /> <br />Budget Impact: This item has on impact to the City's budget. <br /> <br />Recommendation: The City Manager and the City Police Chief recommended approval of Ordinance 09- <br />13 lOon first read ing. <br />
