CASSELBERRY CITY COMMISSION Minutes of October 12, 2009- Regular Meeting Page 9 of 13 ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN LANDS LOCATED IN SECTION 08, TOWNSHIP 21, RANGE 30; REDEFINING THE CORPORTE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE NECESSITY OF FURTEHR QUALIFICATION THEREFORE; PROVIDING THAT EFFECTIVE IN ACCORDANCE WITH LAW THE AREA TO BE ANNEXED SHALL BE ASSESSED FOR PAYMENT OF MUNICPAL AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE SEMINOLE COUNTY CLERK OF THE CIRCUIT COURT AND THE DEPARTMENT OF STATE OF THE STATE OF FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE ." Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 09-1307 was published in the Orlando Sentinel on October 4, 2009. Staff Presentation: Mr. Gerald Paradise, Community Development Director, stated Ordinance 09-1307 provides for the voluntary annexationoffive parcels and two involuntary parcels comprising approximately 5.98 acres ofland. Four of the parcels are owned by the City of Casselberry and are slated to be developed as Seminola Parle Annexation petitions for five of the properties were received in 2007,2008 and 2009 and have been recorded to run with the individual properties. The two involuntary parcels are drainage and access strips comprising.48 acres titled to Marie M. Haas, whereabouts unknown. County staff and City staff has been unable to locate Ms. Haas over the years. The last indication of her actions was in 1951 when she signed the plat for the properties. Because the taxes are below $5 in value on the subject two properties, there are no delinquent taxes on the property and the Tax Collector has not taken any action for these properties. The subject properties are contiguous to residential on the south and east. The properties front on Seminola Boulevard for a distance of approximately 600 feet and are currently zoned for mixed residential purposes. Collectively, the subject properties are adjacent and contiguous to the City limits; will not create an enclave, are reasonably compact, and are in an urban area, meeting the statutory criteria for annexation as established in Chapter 171, Florida Statutes. Seminole County was provided notice of the annexation on September 18, 2009, pursuant to Chapter 171, Florida Statutes. The properties have a Seminole County High-Density Residential future land use and an R-IA (single family) and PUD zoning designation. Budget Impact: The properties are valued at $624,245 and currently provide $1,122 in County property taxes. The properties will provide $380 in City property taxes and an estimated $464 total fiscal impact as currently developed. Recommendation: The City Manager and the Community DevelopmentDirectorrecommended approval of Ordinance 09-1307 on first reading Public Hearing: The following individual came forward to address Ordinance 09-1307: 1) Mr. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition tcOrdinance 09-1307.
